    On Thursday, former President Donald Trump and co-defendant Walt Nauta filed their response to special counsel Jack Smith’s motion to move the start of their trial on charges related to classified documents and obstruction from August to December of this year. The defendants took an unusual position. Their lawyers told Judge Aileen Cannon there was no need to set any trial date at all. In their view, the case could and must wait at least until after the presidential election is held in November 2024.

    Smith shredded the defense position in the opening paragraphs of his reply brief by pointing to something so elemental that the defense team should be embarrassed. Apparently, it failed to read the statute. The Speedy Trial Act, which governs the timing of trials, requires that “In any case involving a defendant charged with an offense, the appropriate judicial officer, at the earliest practicable time, shall, after consultation with the counsel for the defendant and the attorney for the Government, set the case for trial on a day certain, or list it for trial on a weekly or other short-term trial calendar at a place within the judicial district, so as to assure a speedy trial.” In other words, the judge must set a trial date. It’s not optional.

    I am certain the defense team knows that judges have to set things for trial. This isn't some ineffective assistance of counsel thing. They are trying novel strategy, based on Trump's desire to milk this through the campaign and hopefully ride it into the White House again. Can you imagine a president elect being put on trial in America?

      Which is as good a reason as any to ensure a speedy trial.

        Exactly. The real object here is to avoid it, get elected and then destroy the independence of the DOJ and have a new AJ dimiss the charges.

            Given recent polling the DOJ better hurry becssue Biden isn’t looking very good at the moment.

              It's in Judge Aileen Cannon's hands right now. The special prosecutor has moved as fast as could have been reasonably expected. Before he was appointed, AJ Garland really failed. Thank God for the House select committee for securing the testimony they did to force Garland's hand.

                            And this is my concern on any of the cases against Trump--a hung jury.

                            But even if prosecutors have a strong legal case, Trump would need just one holdout juror to trigger a mistrial. Given the politically fraught nature of the case, that would likely be prosecutors’ biggest concern ahead of a trial - and make the jury selection process critical to the outcome.

                            “The danger here is that they get someone on the jury who is there for political reasons,” Gibson said. “Trump’s team can’t just insert people into the jury, but the reality is that almost half the country voted for him.”

                              True. But these charges all had to go through a grand jury comprised of citizens just to get to this point.
