    Not only was he not in front of the vehicle when he shot through window shield at an angle, the other officer trying to open the car door was in his line of sight and could have also been shot. That was on top of citizens walking around the other side of the car, amongst many other people there in a suburban neighbourhood.

    The officer was grossly reckless, and obviously poorly trained. There is no defence for his actions.

        The video and testimony of the eye witness (link above) is pretty damning ... the officer was at an angle to the front of the car, not in front of it. He was grossly reckless.

            I think there is an argument for it being justified. I doubt that he will get in trouble.

              There is no justification for firing a gun in that situation with that many people around—his actions were reckless.

                    I've watched all the available videos. I do not find your assessment to be accurate. The officer was definitely in front of the car. She turned right into him and hit him as he sidestepped and fired.

                      The assessment is accurate. The eye witness account is fresh—she shot the video. The legs of the officer who shot the driver are visibly beside the the vehicle, not in front and the wheels are turned away from him—she is trying to drive away:

                      the other person behind the vehicle is also possibly in his line of sight. The officers actions were reckless and not justified.

                            I doubt it's going to be seen that way by the people who are paid to judge this sort of thing.

                              Who are the people getting paid to judge this sort of thing? ICE? DHS? If so, no doubt they will brush it off.

                                That's a possibility. I don't think it will stick.

                                I reached out to a couple of cop buddies to get their take. One is a sergeant and the other a detective. Interesting that they are split in a similar fashion to those participating in this discussion. The first wasn't too enthused about the shooting and felt that Sim Gill would probably try to prosecute it if it were a Salt Lake County cop. However, the feds have different rules, and the agent will slide.

                                The second felt it was justified.

                                I have a cousin who is a DHS agent. If I get the chance, I will reach out to him.
