This is about money and timing of potential penalties. Filing suit delays payment while they get to play in the Big 12 and cash Big 12 checks.

I'm sure it makes a difference that they weren't to first to leave.
Their argument could be that with Pitt and Syracuse leaving, the Big East will not be what it is now. So they should be given the freedom to find a new home for themselves. That new home, the Big 12, is accepting new members now. But may not be in 27 months.
So what will the Big East do to remedy the situation in 27 months if Pitt and Syracuse are gone, and now WVU no longer has an option of the Big 12 and a better home?
I don't think it is too difficult of an argument to make.
However, those two schools are abiding by the law of their contract. Waiting the 27 months before they join their new conference.. This 2 year window should give BE enough time to move on stabilizing their conference. WVU did not give them enough time to respond..

I agree with this. Pitt and Syracuse are abiding by the 27 month requirement so why is WVU so special? Seems like the evidence is against WVU.

Why not? Are the conference's bylaws not worth the paper they are written on?
So I'm guessing that WVU is using the "me too" argument given TCU didn't have to wait the 27 months. Of course, TCU was never officially in the Big East conference.

Okay, well, what will happen (in my judgment) is the judge will say, WV, you go on to the big 12 conference, and we'll adjudicate this. We don't need to be in any hurry about it because the parties are going about their business. And the remedy, if any, will be money.
It seems to me these teams can walk off to the Big 12 conference anytime they want. They just may have to pay damages.
I don't know what the defenses are. The teams may have some legitmate gripes other than buyer's remorse. I'm not crazy about 3D's argument becuse it's the breaches of contract that have bade the Big East not the same conference.
