        Why the WVU Big East lawsuit is a mistake

        West Virginia may well wind up getting what it wants — out of the Big East sooner, with its lawsuit against the conference. But I can tell you why I think filing it is a mistake, and I can do it with only one word.

        Discovery

        For this to work, West Virginia better not have made any inquiries of other conferences before Syracuse and Pittsburgh bolted the Big East. And to find out whether it did, Big East lawyers are going to have wide latitude into phone records of WVU officials — home, office and cell.

        If I’m a Big East lawyer, every official from WVU is going to undergo a body cavity search to examine conduct relating to conference negotiations. And as a by-product, it better hope its higher profile coaches had their phone activity in order. All of this will wind up as public record.

        Beyond that, to make its claim of breach of fiduciary responsibility, WVU will have to explain why it voted in agreement with the league on a number of occasions, and will have to overcome the fact that it was a part of the very activity — the seeking of a new conference home — that it alleges led to the destruction of the league. Any prior activity along those lines likely would show that WVU was as much at fault in causing the situation it says prompted its action as any other school was, or the Big East.

          He just needs to announce that the BE is a superior hoops conference and ask why he would do anything that would undermine his desire to keep WVU hoops in the BE. What better way to approach a situation? This assure Huggie that not only will WVU have offended the BE, likely done illegal recuriting and who knows what other ridiculous NCAA labyrinth rules he broke but they will offend their new conference as well.

          Big-12 is going to need this bad taste out of its mouth by inviting BYU...Bill Schoephlin is marching onto the field.........

            And that is exactly why there was no lawsuit when Nebraska left the Big 12. None of the principals wanted to go through discovery and air dirty laundry - there was enough of it on display already. It also explains why a favorable settlement was reached on exit fees. It is no surprise that the key people involved - Bill Powers president of University of Texas and Harvey Perlman chancellor of University of Nebraska are both attorneys.

                    Concurred that it might not be truth. I simply predicted the points to be made in the complaint. lol @ Georgetown Law grads' ability to read carefully (although georgetown has one of the top tax LL.M. programs in the world)

                      • Rockefeller speaks on WVU and the Big 12. I'm surprised about how brazen he is in implying that federal resources to help the Mountaineers, though that's West Virginia politics.

                        "We've made it clear at every level to the Big 12 Conference that we're ready and willing to extend the runway if that's crucial,” said Rockefeller, according to the Wheeling News-Register.

                          • Sorry Aggies, UT and Baylor are not going to play you after this year so stop asking...

                            The SEC-bound Aggies have said they'd love to keep playing the Longhorns as a nonconference foe, but UT athletic director DeLoss Dodds has countered that the Longhorns' football schedule is full at least through 2018. That isn't the case for all sports, of course, but so far A&M apparently has come up dry in trying to schedule future contests of any sort with UT.

                                Texas A&M will not have a problem filling it's future OOC schedule. Nebraska, for one, will play them to booster their Texas recruiting presence which is needed since the Huskers lost those Texas games after joining the Big 10. It is also worth noting that the Aggie's AD (Dollar Bill Byrne) used to be the Husker's AD. Not sure what A&M's interest would be in playing Nebraska other than having a name program on their OOC schedule that will be a guaranteed sell out at Kyle Field. However, the same could be said about BYU since BYU would also sell out Kyle Field. Edit: Also, no mention of Texas Tech? Tech would play A&M every year since Tech considers the Aggies a rival but the feeling is not mutual.

                                I wonder who's going to win the "spin battle" here in Texas. As you know, the Texas-Texas A&M game on Thanksgiving weekend is a big deal. The Longhorns will point the finger at the Aggies shouting "A&M left the Big 12 so they didn't want to play Texas any longer". Then the Aggies will counter, "We want to play the Longhorns but they won't put us on the schedule." My gut feeling is that this gets done and Texas and Texas A&M continue to play. But my gut feeling was also that BYU would be in the Big 12 by now.
