Yeah, because BYU has tons of non-Mormons applying and getting denied admission…Originally posted by Non Sequitur View Post
I'm no lawyer, but help me understand the difference between Harvard not being able ask an applicant their race and BYU not being able to ask an applicant their religious affiliation. I understand the ruling when it comes to public schools, but it seems that private schools should be able to set whatever admission policies they want.
BYU applicants self select pretty well given that they’ll get thrown out of school if they drink, do drugs, or have sex."Discipleship is not a spectator sport. We cannot expect to experience the blessing of faith by standing inactive on the sidelines any more than we can experience the benefits of health by sitting on a sofa watching sporting events on television and giving advice to the athletes. And yet for some, “spectator discipleship” is a preferred if not primary way of worshipping." -Pres. Uchtdorf

My opinion based on zero expertise is that they are going to block the student loan forgiveness (6-3) and the majority opinion will discuss the overreach of the Biden administration and that Congress should make these decisions because they have the power of the purse. I also think the 3 dissenting justices will say the case should be dismissed on standing, but the majority will find at least one plaintiff has standing. If I am wrong and it goes the other way, I think the decision to uphold would be 7-2, and Alito/Thomas would be the dissenters.Originally posted by Bo Diddley View Post

I really have no idea how they'll rule on the student loan thing. Flip a coin?

BYU might claim it doesn't have official quotas on religious affiliation, but when you give tuition discounts for LDS applicants you're pretty much implementing a quota system.Originally posted by Moliere View Post

Clarence Thomas railing against affirmative action? Irony ruling?
These policies may harm even those who succeed academically. I have long believed that large racial preferences in college admissions “stamp [blacks and Hispanics] with a badge of inferiority.” Adarand, 515 U. S., at 241 (opinion of THOMAS, J.). They thus “tain[t] the accomplishments of all those who are admitted as a result of racial discrimination” as well as “all those who are the same race as those admitted as a result of racial discrimination” because “no one can distinguish those students from the ones whose race played a role in their admission.” Fisher I, 570 U. S., at 333 (opinion of THOMAS, J.). Consequently, “[w]hen blacks” and, now, Hispanics “take positions in the highest places of government, industry, or academia, it is an open question . . . whether their skin color played a part in their advancement.” Grutter, 539 U. S., at 373 (THOMAS, J., concurring). “The question itself is the stigma—because either racial discrimination did play a role, in which case the person may be deemed ‘otherwise unqualified,’ or it did not, in which case asking the question itself unfairly marks those . . . who would succeed without discrimination.” Ibid.τὸν ἥλιον ἀνατέλλοντα πλείονες ἢ δυόμενον προσκυνοῦσιν

The hook is that private schools accepting Federal education dollars under Title VI must, as a condition of accepting those funds, abide by the same non-discrimination standards of the Equal Protection Clause as would apply to any public university.
4The Court has remarked that Title VI is coextensive with the Equal Protection Clause. See Gratz v. Bollinger, 539 U. S. 244, 276, n. 23 (2003) (“We have explained that discrimination that violates the Equal Protection Clause of the Fourteenth Amendment committed by an institution that accepts federal funds also constitutes a violation of Title VI”); Regents of Univ. of Cal. v. Bakke, 438 U. S. 265, 287 (1978) (opinion of Powell, J.) (“Title VI . . . proscribe[s] only those racial classifications that would violate the Equal Protection Clause”). As JUSTICE GORSUCH points out, the language of Title VI makes no allowance for racial considerations in university admissions. See post, at 2–3 (concurring opinion).τὸν ἥλιον ἀνατέλλοντα πλείονες ἢ δυόμενον προσκυνοῦσιν

Love the end of the term for the Court. Makes for interesting reading days. Just need to figure out applicability to any of my projects to account for all the time. Today all the cake makers and web designers can rejoice. They really do have freedom of speech as decided along predictable lines, 6-3. Gorsuch's takedown of Sotomayor's dissent is entertaining, beginning with this shot across the bow: "It is difficult to read the dissent and conclude we are looking at the same case." Does that statement comply with Utah's standards of Professionalism and Civility? Doesn't matter. Re student loan forgiveness:
It looks like they found at least Missouri had standing and overturned the forgiveness by a 6-3 vote. I guess President Biden got the election booth benefit of vote buying without having to foot the half-a-trillion-dollar cost - or, perhaps more accurately, adding that to the bill our children and grandchildren will already be inheriting."What are you prepared to do?" - Jimmy Malone
