    Unanimous on the point that Colorado (or any state, for that matter) does not get to enforce Section 3. Where they differ is that the majority decided the only path for enforcing Section 3 is via an act of Congress, under the enforcement power of Section 5. The concurring justices objected that it was not necessary for the Court to make that decision here; all that was necessary was to say that Colorado could not decide the question, and so anything else should have been left to another day.

    I'm sympathetic to that argument-- the Court generally should not decide more than it has to decide to resolve a case. But I understand why it did so here. If there was any other way to enforce it, a lot of really ugly scenarios would have been left in play. Now those possibilities are effectively off the table.

          I mean, it was 9-0, so I think you can say you support the ruling without being a closet MAGA guy. (Although I love the mental image of Sotomayor wearing the funny hat.)

            Agreed it was the correct ruling. It was a dumb joke playing on the state of the board in the politics forum. I literally expressed my preference for Donald Trump to die but if I also express discomfort with the priorities of the DNC I will be labeled a red hat.

                I agree with the ruling, because the case was leading us down a dangerous path of letting local governments determine the outcome of presidential elections. I fully anticipate cases in the future where republican state legislatures will ignore the outcome of national elections and try to submit their own electors. I hope this is a step towards getting ahead of that.

                • Alito had a stop-the-steal flag outside of his house. He needs to step away from cases related to the insurrection.

                    That was Alito’s wife’s doing. They should haul in that insurrectionist and put her away for 20+ years like they with those other freaks.

                          What narrative is implausible to you? Alito's story is that it was done by his wife in retaliation for some off-color anti-Trump signs in their neighborhood. That story, in and of itself, is questionable. It would be like Sotomayor burning the flag on her lawn in retaliation for a Let's Go Brandon sign in a neighbor's lawn. Add to that it was done right around January 6th. Of course the story should raise some flags (tee hee!).

                          The most benign explanation would be his wife showed extraordinarily bad judgement doing something so easily connected to the insurrection, her being married to a supreme court justice and all. Still pretty bad that he would allow that to happen given the connotations. Less benign would be either her (or him, not out of the realm of possibility) expressing support for the stop the steal campaign. It's not like we haven't seen this happening with the Thomases.

                            Yeah, I agree she showed bad judgment. Sounds like it wasn't up very long. But anyone extrapolating this to Alito believing the election was stolen, etc is crazy.

                              A spat isn't unbelievable, but to me the Alito response is. Put up a Trump sign or even a back the blue flag in response. But doing the upside down flag thing? That isn't plausible to me.

                              And I agree that Alito personally doing this is the least likely option. But it calls into question his judgement. If he tolerated his wife doing it, we should expect him to be smart enough to know of the possible backlash and harm to the public perception of the supreme court that might cause.

                                How do you know she didn't take it down the minute he found out about it?
