Really, you're reading way too much into the discussion of the role of the states in the opinion. The only thing the lip service Justice Kennedy paid to federalism did to move along his argument was to put the ball on the tee: sometimes the federal government can do stuff with marriage, and sometimes, it can't. When the majority said why THIS particular intervention was impermissible, it was because the act discriminates against gays. That same reasoning will carry the day when the next case comes up, too. if an LDS business owner ran a restaurant, they would serve gays and smokers and drinkers and non tithe payers. So why would they exclude gays if they owned a cake business or a photography business? Same-sex marriage now coming to Nevada, also. And the 9th circuit uses Windsor to establish gays as a protected class which requires intermediate scrutiny. . . . at least as far a jury selection goes. This link is fairly one-sided (do you expect anything else from Slate) but it walks you quickly through the procedure leading to yesterday's withdrawal by Nevada's AG.

After a long discussion with my boys this weekend, I am now an advocate of gay marriage everywhere. Utah's case is doomed, because that ("traditional values") seems to be the foundation of their case. The flaw in that logic is further dissected here:These sentences did nothing less than herald a new era of gay rights. For decades, gay activists have strived for this precise constitutional protection; now the 9th Circuit had afforded it to them. No longer, the 9th Circuit declared, can gays be denied basic rights based on some vague notion of traditional values. Instead, a state must have a compelling interest in discriminating against gays—and because no such interest exists, they must be afforded the same rights as everybody else.
The ruling only applied to those states within the 9th Circuit’s jurisdiction, including—you guessed it—Nevada. When the Abbott opinion was handed down, Nevada’s attorney general was already struggling to defend the state’s marriage ban; following Windsor, she asked for a series of extensions in light of the changing legal landscape. A federal judge had upheld the ban in late 2012, but that was during the dark days of DOMA; now, in the shadow of Windsor, the state’s argument that it must discriminate against gays in order to “preserve traditional marriage” was beginning to look a little flimsy.
