Thank you very much for having interest in our story. This is Jake's Sister In Law, who has been running the blog. JAKE 100% does want his son back. It's so awful the way the laws are set up in Utah. They give unmarried father's ZERO chance to raise their son if they want the option. Jake was with Whitney through her entire pregnancy. He attended doctors appointments, gave her substantial amount of money, welcomed her into his family even though they were not a couple. Jake took Whitney to lunch on a very frequent occasion. He was in contact with her every single day. On December 28th, the night before the birth they went to temple square with his family to look at the Christmas lights. That very next day, she went into pre-term labor and did not notify Jake of the birth. Jake even joked around with her the next day and asked if we were having a baby today? At this point she had already the baby and given him up for adoption. In text messages Jake even asked how her last doctor's appointment went and she replied "good, no change." NO CHANGE????? Pretty sure you are NOT pregnant anymore, I think that is a really big change! She lied throughout her entire pregnancy. She had planned on giving up the baby the entire time. She had been working with a case worker since June. She was taking Jake's money with zero intentions on keeping the baby. Not only is the law messed up and is there only to protect the mother, but it enables mothers to fly to Utah to take advantage of the law, because they know that the father is more than likely not going to have any chance against LDS FAMILY SERVICES or the State of Utah who is ran by the LDS faith.Originally posted by Miner_chick View PostThat whole family wants Jackson back. Adoption can be a great thing if it is willing from both the mother and the father! It took two people to create this special human being and the most precious thing in life was ripped away from his father who wanted him.
Jake is a wonderful person who's life has been shatter! He most likely will NOT get his son back, BUT when he is 18 his son will know the whole truth! He will be told he was STOLEN not given up willing and his father fought as hard as he could! Justice will be served. Oh, and it is the Whitney Pettersson who's son was brutally murdered and his killer got off. Classy lady eh?
What would you do if you adopted a child that you found out was not rightfully given up? Would you want to make amends and give the child back or would you keep a child you know was taken from a loving and caring home unwilling, because unfortunately the adoptive family knows the situation

If I adopted a child under these circumstances, and found out that the family believes such idiotic things as yours apparently does, I'm keeping the kid. I have had a dozen or so people come to me in the same situation and I have to tell them that the laws of New Mexico are similar to those of Utah. This area of the law is rife with abuses and is in drastic need of a change. I don't blame someone for feeling that the laws of a state are unfair.
I don't agree w/ her conclusion but the sentiment that drives it is understandable.

In my state the FOB has no rights to the child. Quite frankly, I agree with this here in this area. The FOB spent 3 minutes doing his part...MOB spent 40 weeks doing her part.
Her body, her baby, her choice.

I was not blaming the LDS church, for the circumstances. I was saying that because of the LDS faith and their belief in a traditional married mother/father family home as opposed to a single father or single mother the laws are pro-family even if the single UNWED father wants the child.
The law in the state of Utah says that unwed father's must file on the Putative Father Registry within 24 hours of the birth, BUT the law also states that the mother does not have to notify the father of the childs birth. The law also says if there is FRAUD or DURESS (Which there was both of) used in the case IT DOES NOT MATTER. In only two states Utah and Massachutes this occurs. In every other state the father has a period of 10-30 days to file on this registry. Jake did file on the registry the day he found out about the adoption, but he was too late.
Have you ever heard of the putative father registry? It costs hunderds of dollars to register and you have to have an attorney on hand who usually requires a couple thousand dollar retainer. Why should a father who wants to raise his child, had everything ready for his child (crib, stroller,diapers, stroller, toys, money, health insurance, family support and most imporantly LOVE) have to file on a registry "just in case?"

This is beside the fact about the LDS Church. You really are missing the big picture. The fact of the matter is there is a father who wants his son and will do anything he can to have a relationship and get him back.
What would you do if someone took your son away? YOU WOULD BE DEVASTATED RIGHT? Would you just let someone say, sorry you didn't file a piece of paper on time?
