This article sure makes it seem like the waiver would give the Big-12 the ability to have a championship game with only 10 teams. He also seems to think that the PAC-12 is in favor of this waiver for the same reasons the ACC are.
This quote leads me to think their request is based off of 12 teams still. The issue is related to the 2 divisions and them playing in the title game.
The intent is to allow leagues their preference in how to determine their conference champion. It would theoretically eliminate the need -- per NCAA rules -- to split into divisions with the division winners meeting in a conference championship game.
That would benefit the ACC and other conferences which have expanded to the requisite minimum of 12 teams (and two divisions) to stage a championship game. Theoretically, with passage of the legislation, any of those conferences could play in one division and still stage a championship game.

I would be worried about the rumor if FedEx were a private company. As a public company, there is no way shareholders would stand for wasting money like that.
