        I agree. JL, your focus is too narrow here. FDR tried to pack the courts to prevent his New Deal programs from being killed. That was the hole point. In the end, he didn't need to pack the Court because they caved. He won. It wasn't about changing the Court, it was about the programs themselves.

                    Maybe you can help explain your original point. You seem to be glad that he failed in his attempt to pack the court, but why? Presumably so that the balance of powers could be preserved and thereby not allow the president to control the judiciary. But the opposite is what actually happened. He got exactly what he wanted. So I don't really see what the point of your satisfaction is that FDR failed in adding to the number of justices so that he could control the court. Sure he didn't get to pack the court, he didn't have to, he got what he wanted by mere threats. There is nothing sacred about the number 9. So what if he had 12, 15, or 18 judges who were willing to do his bidding....he had 5 and that is all he needed. So why are you so satisfied that he didn't have 12 justices or 15 justices doing his bidding, how would that have changed the result?

                      Yes, I am happy he was not able to permanently change the rules to make it easier for the president to manipulate the court, including a flexible number of judges all the way up to 44. That would have had a far more negative and long-lasting impact than what actually happened. Yes, he got much of his legislation passed, just like he and other presidents have done countless times. But he was forced to do it without the benefit of a fundamental restructuring of how the court operates.
