I'm no lawyer, but help me understand the difference between Harvard not being able ask an applicant their race and BYU not being able to ask an applicant their religious affiliation. Yeah I noticed this distinction in the opinion. They can't ask them to check a box, but they can certainly mention how their race has presented challenges in their life and educational journey. They just can't 'consider' race as its own stark category. Say what you will about the benefits of affirmative action, at the end of the day it results in individuals being discriminated against solely on the basis of race. Not only that, but the ones bearing the heaviest impacts are a minority (asians). Yeah, this ruling will be VERY popular with many of my Asian friends. I don't have a problem with religious freedom. I do have a problem with forced religious accommodation, especially when that accommodation is pretty much just for the Court's religion of choice, the Christian religion.
