I'm no lawyer, but help me understand the difference between Harvard not being able ask an applicant their race and BYU not being able to ask an applicant their religious affiliation. I understand the ruling when it comes to public schools, but it seems that private schools should be able to set whatever admission policies they want.

I'm not as informed on exactly what the ruling said. Can universities not even ask race now?

              • Say what you will about the benefits of affirmative action, at the end of the day it results in individuals being discriminated against solely on the basis of race. Not only that, but the ones bearing the heaviest impacts are a minority (asians). Not surprised at all with this ruling.

Yeah, this ruling will be VERY popular with many of my Asian friends. Several of them have been very vocal in their displeasure of Affirmative Action in college admissions.

                    • Boom. Another ruling. This one is 7-0 in favor of religious freedom (trigger warning for NS).

If you really cared about triggering NS, you would have put all that under a spoiler tag.

Clarence Thomas railing against affirmative action? Irony ruling?

I don't have a problem with religious freedom. I do have a problem with forced religious accommodation, especially when that accommodation is pretty much just for the Court's religion of choice, the Christian religion. If this case were brought by a Muslim who didn't want to work during Ramadan, I'm not sure the result would have been the same.

I don't mind being triggered. What else am I going to do on a Thursday night?
