          In a completely unsurprising opinion given that (1) Nevada stopped fighting the constitutionality of the provision of the state constitution, and (2) it was before the bloody Ninth Circuit, the Ninth Circuit invalidated the provision and a similar one in Idaho today.

                    From Alpine, Utah, to Queen Creek, Ariz., same-sex couples can now marry across the “Book of Mormon Belt.”


                    Members of the Church of Jesus Christ of Latter-day Saints make up at least 6 percent of the population in five Western states where marriage for same-sex couples has become legal within a 16-day period: Arizona, Idaho, Nevada, Utah, and Wyoming.


                    Utah, 68 percent Mormon, was the first of the five on Oct. 6, followed by Nevada on the 9th, Idaho on the 15th, Arizona on the 17th, and Wyoming Tuesday morning at 10 a.m.

The swing vote on the court is a pretty staunch conservative jurist, but one who is a bit unpredictable (he wrote the first opinion upholding Obamacare, for instance).

                      They went 2-1 in reversing the district court decisions that invalidated the state bans on SSM. It seems the USSC would need to look at the issue now.

                      On a side note, I notice a Kirton McConkie attorney was in on this.
