Our country doesn't criminalize libel. However, the First Amendment is a defense to all kinds of civil lawsuits that involve speech, but not libel, if the elements can be proven, which isn't easy. Just because we don't criminalize it doesn't mean that it's protected by the First Amendment. There's a lot of case law that says libel is not protected by the First Amendment. See New York Times v.
