    In theory, the individual mandate should work. Of course, Massachusetts thought their individual mandate would reduce the problem with "free-riders" or those without insurance that get free ER care under EMTALA. In practice, it made things worse...

    As John Goodman of the National Center for Policy Analysis has often pointed out, in Massachusetts, where an individual mandate was instituted in 2006, emergency room traffic is higher than ever before. Indeed, between 2005 and 2007, Massachusetts ER visits rose by 7 percent, and the state’s costs of caring for ER patients rose 17 percent between 2007 and 2009.


    The uninsured don’t even account for their fair share of health expenditures. A Kaiser Family Foundation study found that, while the uninsured made up 15 percent of KFF’s surveyed population, the uninsured accounted for only 14 percent of total ER visits, and only 12 percent of aggregate ER expenditures.


    By contrast, Medicaid beneficiaries accounted for 9 percent of the population, but 15 percent of visits and 9 percent of expenses. (For those with private insurance, the stats were 60%, 47%, and 54% respectively; for Medicare beneficiaries, 14%, 20%, and 22%.)


    Why does this happen?


    It’s pretty simple: if your health care is paid for, you are more likely to see the doctor more, and consume more tests and procedures, than if you are uninsured. Hence, people with insurance consume, on average, twice as much health care as do the uninsured.


    This problem leads to more ER crowding, poorer access to emergency care for the truly vulnerable, and more losses for hospitals. Hospitals can’t make more money on patients if they are turning those patients away due to capacity constraints. (Remember that the biggest part of how PPACA covers the uninsured is by expanding Medicaid.)

    As VC pointed out, the individual mandate was really a conservative idea and a Heritage Foundation proposal. Given that they realize that the government will just screw up the implementation and other reasons (...) they have now backed away from the idea:

    Stuart goes on to give four reasons why he and Heritage no longer support the mandate: (1) a mandate isn’t necessary because “the new field of behavioral economics taught me that default auto-enrollment in employer or nonemployer insurance plans can lead many people to buy coverage without a requirement;” (2) “advances in ‘risk-adjustment’ tools are improving the stability of voluntary insurance,” as illustrated by the Federal Employees Health Benefits Program; (3) Obamacare’s mandate forces people to buy comprehensive coverage rather than catastrophic coverage; (4) Obamacare’s mandate is unconstitutional.


    Stuart, of course, is perfectly entitled to change his mind, and the reasons he gives for having done so are ones I’d agree with. (I would also point out, as I do repeatedly in this space, that the “free rider” problem is grossly exaggerated, and that an individual mandate actually increases free-riding.)

      If it were only catastrophic plans, then how could we prevent Sandra Fluke from reproducing?

              • John McCain joins Ted Cruz in calling for a repeal of Obamacare:

                McCain outlined his “solution” during an interview with Greta Van Susteren, which culminated in an admission that the law should be repealed completely.


                “The solution is, first of all, to let people keep their insurance if they want to,” he said. “Or at least reinstate them.”


                He continued: “Second of all, let the insurance companies give a menu of whatever they want to provide. Third of all, medical savings account. Fourth of all, medical malpractice reform. Let people go across state lines to, in order to, if they can get a better insurance policy in another state. And remove this whole tax incentive for employers to provide employees health insurance.”


                “That is repeal,” Van Susteren said, pointing out the obvious.


                “That’s exactly right,” McCain replied. “That is total repeal in every other way. Because what Obamacare is, is an experiment in social engineering — in other words, making healthy people pay more…in order to subsidize the health care for people that are older and unhealthy.                 It doesn’t appear that McCain misspoke in calling for the full repeal of the Affordable Care act as the TV producers seemingly placed the caption “Sen. John McCain Calls for Total Repeal of Obamacare” on the screen before he actually did, hinting that it may have been planned.

                  I wonder if the irony of democrats introducing and calling for legislation to postpone the mandate is registering with most people. Because at the same time the dems are still whining about the shut down. I think the last proposal the hardliners made was if they would delay the mandate they wouldn't shut down the government. The dems said absolutley not.

                  I am still not a fan of Cruz and Lee and their tactics, but compared to Harry and Nanci, they are top notch.

                      Is the horse out of the barn? Will the insurance companies even play ball and continue these policies after they've put years into preparing for these exchanges? I'm not asking this rhetorically, I honestly don't know.

                      Either the insurance companies won't play along because it would be too much of an administrative headache to extend people for only one year, or they do play along and this just hastens the death of the exchanges. By this time next year, they'd look at the exchange failure and call for another delay.

                      The other thing to keep in mind is some insurers have already left some states, they're not going to come back because of a one year delay. So, I'm inclined to believe that a combination of the two things above will happen. Some insurance policies can still be renewed for another year, others can't and there's not going to be close to enough people on the exchanges.
                      Part of it is based on academic grounds. Among major conferences, the Pac-10 is the best academically, largely because of Stanford, Cal and UCLA. “Colorado is on a par with Oregon,” he said. “Utah isn’t even in the picture.”

                          Can he do that. I thought that was one of the dems clarion calls leading up to the shut down. It is law, you can't change it. Maybe they should have said, no mere mortal or mortals can change it, but President Obama can and maybe God could.

                          • I also have a better answer relating to ER and my Humana plans being extended into 2014. Apparently the insurance companies have always had the option of doing an early 2014 renew by December 2013. Ezra Klein clarified this in a tweet where he is essentially commenting that Obama's fix essentially means nothing as to whether people's plans will be cancelled or not.

                            So, the real reason why Obama is doing this is to shift the spotlight onto insurers and blame them for dropping coverage.
                            Part of it is based on academic grounds. Among major conferences, the Pac-10 is the best academically, largely because of Stanford, Cal and UCLA. “Colorado is on a par with Oregon,” he said. “Utah isn’t even in the picture.”

                              That is what my company did for our insurance. We get the same plan until next year then we will join the shitstorm.
