Four legal opinions, 2-2 for and against. Also of interest is the one expert who has made those types of decisions said it's legal. On the question of pretext, I'd liken it to my experience prosecuting and defending DUIs. The law is well settled that if a cop is waiting outside a bar all he has to do is find some valid basis for a stop other than the driver just came out of a bar. While not a perfect comparison, if there is a valid reason for collecting the signatures other than paying to get someone registered or to vote, he is likely in the clear, or as the experts call it, the legal gray area.

I'm enjoying the $5K or so that magically appears in our checking account on the second Wednesday of each month, but I grieve for our grandchildren and sincerely wish either party had the political will to make changes, even if it reduced my windfall a bit. Extending the retirement age and capping the monthly payment for high income recipients would be a good start.

I plan on stuffing it all into my grandkids' 529 accounts... it would be more of a benefit to them than any kind of government social program.

Completely agree, though I think it's prudent to wait about 30 years before capping payments for high-income recipients.
