On the question of pretext, I'd liken it to my experience prosecuting and defending DUIs. The law is well settled that if a cop is waiting outside a bar all he has to do is find some valid basis for a stop other than the driver just came out of a bar. While not a perfect comparison, if there is a valid reason for collecting the signatures other than paying to get someone registered or to vote, he is likely in the clear, or as the experts call it, the legal gray area.
