dischargeability is the winning answer here. bankruptcy is not some get out of jail free card--it's a real decision with tough consequences and bad outcomes. plus, people who shouldn't get relief will get means tested into ch 13. people who have educational debt that will provide them with an income or for whom the risks of bankruptcy would outweigh the present value of their opportunities will not be willing to bear the cost.Te Occidere Possunt Sed Te Edere Non Possunt Nefas Est.

PA supreme court rejects trump argument.
The ruling is likely to undercut the Trump campaign's case in federal court contesting the results of the election.
Giuliani claimed that one of the main problems in Pennsylvania is that Republican election observers weren’t allowed to get close enough to the vote counting tables in Philadelphia to get any meaningful idea of what was going on.
The Pennsylvania Supreme Court, however, said all state law requires is that observers must be allowed “in the room” where ballots are counted. The law does not set a minimum distance between them and the counting tables.
The legislature didn’t provide one, and the court can’t, either. The ruling says the legislature left it up to county election boards to make these decisions. And in the case of Philadelphia, the local board “fashioned these rules based on its careful consideration of how it could best protect the security and privacy of voters' ballots, as well as safeguard its employees and others who would be present during a pandemic.”
Observers are there to watch, it said, not to audit ballots.
The witness who testified in court said he could see the entire counting process, the court found.
The court's vote was 5-2."There is no creature more arrogant than a self-righteous libertarian on the web, am I right? Those folks are just intolerable."

So - does "or otherwise" include mortgages? I also need to know if "or otherwise" includes credit cards and auto loans - but please let me know prior to deciding to forgive it all. I've got a few purchases I need to make before loan amnesty hits.Originally posted by Jeff Lebowski View PostIt is just incredibly stupid for them to push for this right now. If I were a republican strategist, I would hammer away at this non-stop in TV ads in Georgia. "See, this is what these clowns will do if you give them the senate."
Just look at the replies in this thread.

Maybe they are not originalists and think the judiciary should rule in a way to allow them to be more auditors than observers, since maybe that is what should be meant by the lawOriginally posted by Now who’s the dean? View PostWTF is up with the 2?

We cannot expect to experience the blessing of faith by standing inactive on the sidelines any more than we can experience the benefits of health by sitting on a sofa watching sporting events on television and giving advice to the athletes. I think I read that one of them argued that the point should be ruled moot. I'm not a lawyer, so I don't understand the distinction.Originally posted by Now who’s the dean? View PostWTF is up with the 2?"The mind is not a boomerang. If you throw it too far it will not come back." ~ Tom McGuane

Before 1998, you had to wait 7 years after college before being eligible for discharge. Such a system could be reinstated. Having practiced primarily in Bankruptcy for 10 years before gradually transitioning into where I am now, I think the best way to help those who truly need it would be to have dischargeability available after a buffer period to show a good faith effort, such as 7-10 years, but also to relax the definition of undue hardship that the courts have promulgated over the years. It is currently defined as the inability (now or in the future) to repay the student loan debt and still maintain a minimal standard of living and a showing of a good faith effort to pay. If I remember right one court went so far as to state "certainty of hopelessness" as its standard.Originally posted by Sullyute View PostI agree that there are some serious issues in the cost of higher Ed, but if student loans are dischargable in bankruptcy (outside of hardship) what percentage of students would file for bankruptcy right after graduating? How would that affect the interest rate for those that do pay their loans back?
What if they allowed for the discharge of student debt that is not directly tied to tuition? So room & board, books, laptop, etc.
I think eliminating the future considerations and requiring a showing of a good faith effort in the buffer period mentioned above is all that it should take. After that, the same test as with other debts should apply using the bankruptcy schedules that are based on the code. As stated by OG, there are real consequences to bankruptcy, especially if you have built up assets in the interim while ignoring student loans. There will always be certain loopholes that can be used and people who abuse the system, but the current system treated whatever abuses of the system in the past like throwing out the a 70,000 vote victory over a couple of anecdotal tales.“Every player dreams of being a Yankee, and if they don’t it’s because they never got the chance.” Aroldis Chapman

The biggest surprise to me reading that is that he was the US Attorney for the Southern District of NY. It is good to have good people below you holding you up, apparently.“Every player dreams of being a Yankee, and if they don’t it’s because they never got the chance.” Aroldis Chapman
