Perhaps so. But I think it's also valid to question whether politics is playing a role in Judge Cannon in the classified documents case and the conservative leaning Supreme Court allowing Trump to delay those trials beyond what's reasonable, or at least long enough that no resolution is possible before the public gets to vote.

Weren't the delays more a product of the DOJ dragging its feet initially? No doubt the delays help the Trump campaign but my understanding is its just as much due to DOJ actions. I could be wrong.Originally posted by BlueK View Post

I don't think that's true of the classified documents case. That one was brought fairly quickly but has been bogged down by a questionable judge who seems to be trying pretty hard to fall for every single delaying tactic even after being reprimanded by the appeals court a couple of times. The January 6th one yes the DOJ was ridiculous. Congress forced its hand there by its investigation. But do we really need the Supreme court to slow it down to address the frivolous claim of absolute immunity?Originally posted by USUC View Post

I think people argue that the DOJ was "dragging its feet" because it didn't file the election interference case for three and a half years after January 6th. I'm sure some things didn't move at optimal speed, but not enough to blame the DOJ for this. The FBI and the DOJ were also dealing with the hundreds of J6 rioters, and those are people they already knew had committed crimes. Plus, the FBI and DOJ had just come survived the one-two punch of James Comey reopening the Hillary email investigation and the Russian election interference investigation. They were moving very carefully and followed the evidence as it developed instead of picking the target first and looking for evidence after. And with the change in the WH, the DOJ knows it will be getting a new boss and who knows what that person will want to do. Garland was appointed in March 2021 (3 mo.). FBI and DOJ investigate massive potential election fraud involving then President of the United States, which you can imagine requires you to be thorough. The Jan 6 Committee took 18 months for its report and investigation on the same subject (final report Dec. 2022) DOJ develops enough evidence to suggest that Trump is involved and a special counsel needs to be appointed. Jack Smith appointed November 2022.
That's all before Jack Smith even starts. He's got to assemble his staff, get everyone on board and running at the same speed. During the holidays. He's got a head start from whatever the DOJ could give him, but to be "independent" (and to just be a good lawyer) he'll need to have his people investigate and confirm. He goes from basically ground zero to indictment in 7 months (indictment on Aug. 1, 2023). Same ground covered by the House (when the info was much more fresh) in 18 months, but with the added pressure of being the lead person investigating and charging the former President of the United States. The House Select Committee was just a movie - no one really watched, nothing was on the line. Jack's going to be hated whether he wins or loses, but he'd rather be hated because he won. He wouldn't half-ass this job.
Cherry on top - Jack Smith has urged all the courts to go act swiftly so the trial can happen before the election. The US Dist. Judge did. the Fed App. Circuit did. The conservative supreme court is flipping Jack Smith off right now, but who knows, maybe they feel some of the same pressure Smith does.Ain't it like most people, I'm no different. Lol, Wall Street loving the Trump conviction. Lots of people on Fox predicting a 2% drop in the Dow if there was a conviction. Instead, DOW has its best single day in 2024.

I wish politics could be divorced from criminal justice system but it never will be. With the polarization of our country, it's only going to get more political until we can moderate.
