Complete garbage.* So a Dem president can create something with the stroke of a be pen, but a Rep president can't undo it in the same manner? That's ridiculous.

I get it. Roberts is trying to prevent court packing from the coming new administration. But this gets us no closer to limiting executive power and returning Congress to their constitutional role.

*Trump's immigration policies are absolute shit, no doubt.

LOL... the supreme court just gave the "never drumpf'ers" a renewed reason to re-elect drumpf... "We can't let those SoB liberals pick supreme court justices. The supreme court is still too liberal! Please hold my nose while I vote for Drumpf."

You still have 5 months left to convince us you're not voting for Trump. Keep your powder dry Ted!

Embarrassing take, man. Read the decision. If Trump had bothered to follow the prescribed method of rescinding an executive order it would have not been an issue. As it is, he has trouble reading and paying attention in meetings, so that was a pretty tall ask.

this seems more plausible than the court not "liking" him

Embarrassing take? Surely I am no legal scholar and won't even go into how I scored on the LSAT (not good), but isn't this essentially what the dissent by Thomas, Alito and Gorsuch says?

"Trump administration rescinded DACA the same way that the Obama administration created it: unilaterally, and through a mere memorandum. Today the majority makes the mystifying determination that this rescission of DACA was unlawful."

'The stroke of a pen in, stroke of a pen out' is facile. Maybe I was being too mean, sorry, but I guess that was Trump administration's whole argument. The APA requires articulated reasoning and all they provided was that DACA was 'legally questionable.' That is not a legal argument at all and it's crazy that they rested on that rather than just issuing a new articulated decision rather than ride their bungled response all the way to the Supreme Court.

The first thing in the Court's decision clarifies that 'all parties agree that DHS can get rid of DACA at any time. Nobody disputes that.' And Trump's people were given multiple warnings by lower courts that they weren't doing things correctly. That's why it's incorrect and misguided to say that 'oh a democrat can just do whatever he wants and republicans can't undo it ever?' No, but when the 'republican' is completely incompetent, that can be the result, though.

So they thought that it would be easier to get a rubber stamp from the conservative supreme court than actually justify what they did?

It's probable that Trump had very good attorneys tell him to redraft the rules but he fired them until he found one willing to do it his way.

Thank you for the clarification. I appreciate your point of view.

I should not have used the party affiliation when comparing executive orders of presidents. It gives the impression that I am supportive of Trump or that I'm excusing his actions by whataboutism. I probably conflated this with the overall "rules for thee, not for me" fervor that is becoming pervasive among progressives in media and government. I have no doubt that Trump will be gone and the Senate will be lost by the GOP. But just as the reckoning for Trump and the GOP is ensured, so will the reckoning for the progressive overreach and cancel culture happening now. I want level-headedness and competency to return to the GOP. And that nonsense gives nothing but fuel to the Trumpians who will remain. But this is unrelated to the topic at hand.
