I'm no expert on this like AA, but I'd be curious to see an example of the time he voted based on his wife, which I'd then expect to be something outside of his historical jurisprudence. Maybe it exists but it would be good to see evidence of what you are saying.

When he was the 1 in the 8-1 decision that threw out Trump's executive privilege claim to disallow the Jan 6th committee from accessing the texts, documents, and testimony of people working for Trump related to what a losing president was trying to do to keep from leaving office, culminating in a violent attack on Congress to prevent them from transferring power to the next president. His wife's texts with Mark Meadows heavily pushing for the fake electors scheme, among other dubious things, were included in that. Before all the craziness of the Trump era there is no way Thomas would have been part of trying to prevent a Congressional investigation of something like that.

I'm not buying it. If you had to predict his opinion on a specific case, would you have more luck basing your prediction on his overarching judicial philosophy or whether his decision would be endorsed by the Freedom Caucus? Case in point: If the recent decision by the Texas MAGA judge to halt FDA approval of mifepristone is appealed and reaches the Supreme Court, is there a chance in hell that Thomas would not uphold the ban on mifepristone? It would have nothing to do with judicial philosophy and everything to do with political partisanship.

How he would vote on a case that hasn’t even made it to the court of appeals yet, much less the Supreme Court, I couldn’t guess. Nor could I guess how any such decision would square away with his prior judicial philosophy as compared to whatever the Freedom Caucus would prefer.

What I can say, based on his history, is that he has a proven record of standing on an island, insusceptible to persuasion or compromise—even on arcane and technical points other like-minded jurists long gave up. He’s made the one-man opinion (sometimes a concurrence, usually a dissent) an art form. It’s a source of no small frustration even among those on the right. The idea that he cow-tows to any outside influence is highly suspect.

True, his decisions tends to land in a predictable direction. But I don’t think he needed the Freedom Caucus’s help to get there.

The protest in the TN legislature wasn't fascist. You are the only poster on this board who somewhat regularly, shares tweets from alt right fascist types. Your discernment isn't the best with this stuff.

There are a lot of options short of expelling someone from the legislature. I'm sure if we were to play history we could read how plenty of Tennessee legislators have broken order and been disruptive without consequence.

So I went to DC and got admitted to the SCOTUS bar last month. Not that I'll be arguing any cases there anytime soon, but I guess it's kind of a rite of passage and does make me feel a little bit more connected to my profession. It was a fun experience and I was genuinely entertained during the 90 minute argument I watched (they went way over but it was still fun), which I feel is a bit of progress bc I don't think I was ever too riveted by legal arguments in mundane cases in law school. I guess it was cool to be there in front of the Court and watch each of their interactions with the attorneys arguing the case. It kind of humanized Thomas and Alito for me a little even though I sometimes wonder how they can really agree with some of the opinions they write.
