I would say yes, because the 2nd Amendment doesn't specify what are or aren't arms."Socialism is a philosophy of failure, the creed of ignorance and the gospel of envy; its inherent virtue is the equal sharing of misery." - Winston Churchill

I'm not sure I understand what you're saying. Care to clarify?Originally posted by woot View PostI'll defer to all the attorneys on the board, but I'm pretty sure that's not how constitutional law works."Socialism is a philosophy of failure, the creed of ignorance and the gospel of envy; its inherent virtue is the equal sharing of misery." - Winston Churchill

The argument that the 2nd Amendment protects you if you're carrying claymore mines or a bomb. It's not my place to tell you or anyone else how you interpret the freedoms guaranteed by the Constitution. I wouldn't carry a bomb, mine or chemical weapon, but I won't demand that you not do it if it's protected.Originally posted by camleish View Postwhat argument? it's an honest question.
My point, is that a handgun is considered a firearm and carrying a firearm is protected by the 2nd Amendment."Socialism is a philosophy of failure, the creed of ignorance and the gospel of envy; its inherent virtue is the equal sharing of misery." - Winston Churchill

The 2nd Amendment guarantees the right to bear arms. Handguns are arms and therefore, carrying either concealed or open is a Constitutional right.Originally posted by woot View PostPerhaps you could clarify the chain of logic that got you from the constitution not specifying what arms are to the constitution protecting concealed carry in public.

You made about seven leaps in logic there. I will let you find them on your own; you won't learn nuthin' if we point them out.Originally posted by il Padrino Ute View PostThe 2nd Amendment guarantees the right to bear arms. By the way, where in the constitution does it say that the second amendment doesn't apply to felons or the mentally ill?Awesomeness now has a name. Let me introduce myself.

I've not seen anything in the 2nd Amendment that doesn't apply to felons or the mentally ill. But them, I am more a strict Constitutionalist than most people and don't think the document is subject to change. I can understand why there are restrictions, but don't necessarily agree with them.Originally posted by nikuman View PostYou made about seven leaps in logic there. As for the leaps in logic, I don't see what you're seeing. You can point them out if you'd like, but I'm guessing in the end, we'd have to agree to disagree about whatever it is you think I'm leaping."Socialism is a philosophy of failure, the creed of ignorance and the gospel of envy; its inherent virtue is the equal sharing of misery." - Winston Churchill

Basically, I think even some of the more rabid gun-toters would happily admit that the right to bear arms as set out in the constitution does not necessarily protect concealed carry, assault rifles, grenades, nukes, etc. Concealed carry is legal because of later debate and consideration of the implications, not because it's demanded by the constitution.Originally posted by il Padrino Ute View PostIf that is what you believe, who am I to tell you otherwise?
This later debate is also how we got restrictions on who can bear arms, what kinds of arms we want to allow people to own or to carry in public, etc. The constitution is an important piece of this debate, in that it guarantees that at least some people can bear at least some kinds of arms, but it really doesn't seem to have much bearing at all on the particulars. Those result from careful consideration of all the implications on our society.
