      It can vary by state. In Utah, I know you need to have reasonable suspicion they've committed a crime.

      • No right for stop and frisk in that case. Her only articulated suspicion was that he was carrying a firearm in his back pocket. Once he demonstrated it she no longer had any justification to continue to hold him or ask for any ID. However the Sergeant telling her to charge him with resisting when he asked for badge numbers as they were about to let him go just enhanced any complaint he would have lodged. His original complaint would have been harassment and likely would have resulted in unofficial discipline and extra training, but now they are staring down a false arrest claim and the department could be facing civil rights violations based on the incredulity of the Sergeant's line of questionning about the walking stick.

          • I'm completely convinced that without 2nd Amendment reform, all "School Resource Officers" should be federalized. No more local piecemeal nonsense. I want federal training and federal standards and the ability to prevent shitty cops from moving from one school system to the next.

            It's that important.

            • Yet another reason to never open up any letter that looks anything like a jury summons... you will just get harassed by the judge, the stupid court clerks, and law enforcement. And in Texas they only pay a lousy $6 bucks a day! Not even an enough to buy a damn lunch in the court cafeteria. Just throw that sh*t away, man, and stay home and watch the Price is Right.

                That juror is dumb. A judge can have people wear masks in his court room. This brave soul could have complied and put on a tiny paper mask.
                But don't worry, the guy who believes in harassing those who did wear masks, Tucker Carlson is out to make this guy look like a victim.

                    • I don't think that this case is police brutality. Even if someone says "he doesn't have a gun," he gets out of his truck and points his "BB" gun at the cop. While we might all want the cop to show some restraint, that's not human nature. I can't see that the officer did anything wrong.

                        • Anyone who points pretty much anything at a cop from that range, be it a bb gun, a cell phone ,or even finger gun, I can't blame the cop when they shoot.
