    When did the requirement to always have your immigration papers on you come into effect?

    Back when I was a student, there was no expectation of me carrying around my student visa with me.

      Since 1952. The requirement has always been there, it's just that the INS/ICE/CBP have usually had better things to do than to harass random people. That changed on January 20, 2025, when the enforcement of the requirement was deemed a civil and criminal enforcement priority.

      INA 264(e), codified as 8 USC 1304(e):

      (e) Personal possession of registration or receipt card; penalties


      Every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him pursuant to subsection (d). Any alien who fails to comply with the provisions of this subsection shall be guilty of a misdemeanor and shall upon conviction for each offense be fined not to exceed $100 or be imprisoned not more than thirty days, or both.

        A valid driver's license from the USA is good enough in many countries if you want to leave your passport at the hotel. It was fine for South Africa when I was on my mission, although I had my passport in my flat when needed. However, South Africans are required to carry a national ID everywhere they go. If you care to do some research you will find that the requirement to carry ID is common in many countries.

        I'm not in favor of US citizens being required to carry ID everywhere, but I am in favor of non-citizens being required to have some sort of national identification that is easily checked for status.

          My anectdotal experience:

          I was on a student visa for 4 years in Canada. I am now on a work visa and applying for permanent residency. Outside of border crossings, not once have I been required to carry these documents.

          Mrs. NWC was in the US on a student visa for three years, and then a permanent resident for ~15 years. Outside of border crossings and the occasional immigration meeting, not once was she asked to produce it.

          It may be a requirement in the US, but having everyone carry their papers would be a significant cultural shift.

            Trying to remember back to my mission is an exercise. That was a long time ago.

            In the London South Mission, all our passports were kept in a safe at the mission office. Our US driver's licenses were sufficient for driving and I think using the banks. Mine did expire half way through, and I think I renewed it by mail.

            But, per a member who was a Bobby, technically we were required by law to have our passports on us 24/7.

                I watch a fair amount of cop videos (guilty pleasure). If you are pulled over and don't have your ID with you they ask your name, look up your ID in the database and compare the photo to you. No big deal.

                Now if you refuse to cooperate, won't tell your name, won't produce registration, proof of insurance, etc. and claim you are a sovereign citizen not subject the laws of the USA, then you might get your ass tasered and pulled out of the car.

                      Especially when asking you to produce them because you look black or brown or homeless becomes probable cause. The time to push back on this shit isn't when it gets more worse, it was several yesterdays ago.

                          If only we had secure borders, we likely wouldn’t have any reason, justified or unjustified, to be in this situation. Hopefully we don’t have anymore senile old presidents that let ideological leftist run the administration.
