Clerking for Benson may not be the best way to get into a SC clerkship, but Clerking for the guy who becomes and SC justice sure is. Lee clerked for Alito when he was at the 3rd circuit before being nominated to the SC. Alito liked Lee so much, than he asked him to clerk for him when he became an SC Justice.

I'm not sure how that plays into your aristocracy theory. Maybe the deceased Rex Lee appeared to Alito in a vision telling him to choose his son?

Are you suggesting that Alito's love for Michael Lee's father, from his days as Rex's bag carrier at the Solicitor General's office, had nothing to do with his selection of Michael Lee as a Supreme Court Justice Alito clerk about nine years after Michael graduated from BYU? I'm sure not even Michael would claim that (though I do suspect Michael was a star at BYU law, and BYU law has had disproportionate representation among SC clerks becaue of Rex).

It's shocking that Utah politics rewards those with well-connected families! That said, I really do hope son of Wallace can hold his seat against son of Rex. I also hope son of Scott can keep his congressional seat, son of Jon can leverage his stint as ambassador to China into something even bigger and that son of Dixie will one day reappear on the national stage.

Alito on the 3d circuit certainly was an established path to a Supreme Court clerkship, a highly coveted clerkship gig. But Benson was not a likely path to Alito and hence the Supreme Court. I don't mean to disparage anyone. Benson is a great judge--so I hear--and I'm sure Michael Lee is really smart and a great lawyer. It's just that there are certain established clerkship routes to an SC clerkship and Benson is not on that path. A fact of life, no more.

I wasn't aware they worked together. But it sounds like a lot of life. It's all about who you know.

Worked together isn't the half of it. Alito was Rex's shoe shine boy (Rex was always very well turned out, especially in Court with his tails).
