Yes, she was raped. And in that instance she was a victim.

That doesn't excuse her of EVERYTHING that happened prior to the rape. She's still responsible for that.

At least I assume that you wouldn't excuse someone of any crimes they may have committed solely because a they became victims of a violent crime after they were done breaking the law themselves?
um... dangerous territory there. Her behavior was stupid, sure, but I'm sure you're not implying she deserved it?

Ok, good point. Maybe that was the sponsor's intent and this is all on the PD. They certainly should know better.
My experience with police is that confidentiality isn't their strong suit.

Good question for our legal department. I would be surprised if there were none.

Either way, if we are labeling the AA sponsor as the bad guy in this sorry episode, we are splitting hairs at a ridiculous level again.

I didn't say she was the bad guy, just that she probably shouldn't have reported. Anonymity is really central to AA, and is what it makes it a safe place for people to be honest. I can see why she reported, but really, I don't think she should have.
The unequivocal bad guy is the police department, who didn't protect the identity of a rape victim. They should know better.

Edit: and the original woman, of course. But that goes without saying

She's not being charged with any felonies.

I'm bugged at the AA sponsor, but a lot of that comes from my assumption that she didn't first urge the mom to self-report. The story makes it sound like the sponsor urged her to spill her guts, then turned around and called the cops. I think that's poor form, and certainly goes outside the tenets of the program.

The age of consent in Georgia is 16. Unless I'm missing something, her sexual contact with either the 16/18-year-olds, if consensual, wasn't a crime. Disgusting? Yes. But not a crime. Of course, if she were raped as she confided, then perhaps the AA counselor is required by law to report the 16-year-old as a perpetrator of felony rape for the benefit of the victim--the mother.

Providing alcohol to minors is probably a misdemeanor in Georgia. Providing the marijuana to a minor is probably a felony, assuming she provided it.

Absolutely. World class idiocy going on there. Life = ruined over a set of misdemeanor charges.

She is saying the kids brought their own weed, and so far that seems to be the accepted story. I believe she is being charged with contributing to the delinquency of a minor (a misdemeanor).

I also read somewhere that courts have thrown out confessions made to AA sponsors on the grounds that AA operates in a religious space and engages in constitutionally protected religious activity.

                  • AA has no counselor's. Sponsor's are not paid. The so called sponsor broke the trust in a terrible hurtful way.

                    • As for the rape allegation, that would come down to the 16-yr-old kid's word vs. the drunk mom's word. I can't imagine there is a jury in America that would believe her, given the circumstances. Any defense attorney would tear her to pieces. Ain't no way there is going to be a rape charge.

                      What a mess.

                      • On a more positive note, the NY Times has an interesting piece on a BYU grad who edits Hollywood comedies:

White is a Mormon from Orem, Utah, “down the canyon from Sundance,” he says. As an undergraduate at Brigham Young University, he had screenwriting ambitions, with tastes that leaned toward dramatic material; he acknowledges that his faith squares improbably with his career in raunchy comedies. “I’m the one who went off to join the circus,” White says. As a Mormon, “you’re not supposed to see R-rated movies. And when I was at B.Y.U., it was constantly talked about: How do you make movies in this faith?” When White was cutting “The 40-Year-Old Virgin” — a film he interprets as being “about family values: monogamy, chastity” — he amended the title for his kids’ benefit. “I told them it was called ‘The 40-Year-Old,’ ” he says.
