What the hell is he thinking? He could have gotten over this, picked up the pieces and got an OC job at a really good school. Among major conferences, the Pac-10 is the best academically, largely because of Stanford, Cal and UCLA. “Colorado is on a par with Oregon,” he said. “Utah isn’t even in the picture.”

I seriously wonder how many cases are out there where an employer was held liable for money damages because they fired someone due to their alcoholism. Chances are, there are few employee terminations due to alcoholism just for the hell of it. I imagine he cited the bleacher report fan column because he has to prove that his alcoholism wasn't hurting his performance. You need to slow down. The attorney isnt arguing that alcoholics are a "protected class" per se, but that alcoholism is a disability (which is a stupid argument because it isnt at issue, really) and that SC knew and had a responsibility to help him or work with him to get help. Those aren't the same thing. And yes, other states recognize alcoholism as a disability because the ADA (federal) recognizes it as a disability. That being said, as CMBF correctly alluded, if your disability affects your ability to do your job, that protection erodes quickly. And in the case of alcoholism, there are many rules in place that would allow an employer to fire the employee and it sounds like Sark broke those rules multiple times...drinking on the job, drinking affecting his performance, etc.Originally posted by Bo Diddley View PostMaking alcoholics a protected class?
