That hit was legal. He just popped him so hard his helmet flew off. He didn't go underneath his chin or spear him.
I'd say that he technically did have his head down and hit him with the crown of his helmet. I would just argue that he didn't have any legal alternative. If his head were up, it would have been helmet to helmet.
