    How are they being deceitful in doing that?

    They fulfill their obligations if they leave the conference by Sept. 1. They are renegotiating the deal, as it may be more beneficial for both parties to do such rather than have BYU leave.

    Nothing deceitful in there. Anything BYU agreed to they did in good faith.

            It looks to me like that is exactly what they did. They used the knoiwledge they had of the impending arrival of BYU (and the corollary departure of BYU from the MWC) to alert the MWC in order to induce it to promptly exyend invcites even though they only had this knwoledge and only induced BYU to act by having just agreed to NOT go to the MWC. That is more than business, that ius unethical. Remember, the MWC had not invited them until BYU looked to be leaving.

            I realize I am speculating about some of the details, as I ahve said all along.

              we might not agree on the ethics of it all, but I think just about everyone but ER believes that they improved their situation by coming to the MWC

                  It depends on what they end up paying, I guess, but they're stuck in the WAC for two more years. By that time, who knows what things will look like and what part they might have been playing without paying $5 million? What if they paid $5 million (a lot for them) for the chance to be in a reformed WAC under a MWC label?

                  The other thing about this is that we are looking through this from a BYU/Utah POV, where we care about how we stand on a national level. Neither of them are ever going to matter on any sort of national level for any length of time. They should just enjoy playing football and try to break even doing it. Paying $5 million for a really crappy TV deal is not a good first step towards that end.
                  At least the Big Ten went after a big-time addition in Nebraska; the Pac-10 wanted a game so badly, it added Utah

                    Okay, per creekster's timeline who was unethical:

                    1) Some time ago BYU votes to accept Nevada and Fresno into the MWC;

                    2) BYU surreptitiously approaches Karl Benson and the Utah State administrators, proposing to join the WAC if all teams (including aforementioned Nevada and Fresno) submit to a $5 million buy out;

                    3) The BYU initiated proposal is made to Nevada and Fresno;

                    4) Nevada and Fresno rat BYU out to their other MWC suitors;

                    5) The MWC promptly makes the aforementioned executory offer to Nevada and Fresno previously approved by BYU, and they promptly accept;

                    6) The music stops, one chair left, and Utah State and its erstwhile pal BYU are the last standing; bigger nastier BYU pushes Utah State away and grabs it.

                    Who is unethical per creekster's scenario?

                          but turn that around. Could I say that BYU used it's knowledge (that the MWC would invite 2 WAC teams) unethically when it pushed for the exit penalty?

                            btw there are two chairs left...one that most sane BYU fans want to see BYU reluctantly take, and one that I hope USU gets.

                              Nothing wrong with BYU trading on confidential information, though, was there.
