It will be interesting to see if Seau's autopsy shows evidence of brain damage. If it does that is bad news for the NFL. And you have to wonder if Seau's increasingly erratic behavior the last few years (domestic violence and car crash in 2010) has something to do with brain damage from playing football.
Also incredible that life expectancy of NFL players is apparently only mid-50s. They pay a huge price for the sport and it makes it seem like an easy decision for 2-sport athletes to play baseball or basketball instead.

A waiver like that would not be enforceable in my state or a lot of states. What they could do is have them sign an acknowledgment stating they understand that all of these things are risks (it sets up what is called an assumption of the risk defense) but if what he was suffering from wasn't on there or if the NFL deliberately covered it up then the NFL is in hot water.
It reminds me a bit of the tobacco litigation. On the one hand you can say, of course everyone knows that is bad for you, but if you have the manufacturer insisting it's not and withholding data that shows it is....again big problem.

Remember this helmet worn by Mark Kelso back in the day?

Someone was making the comment last week that the NFL should consider going to these helmets. Of course, it would have to be mandated by the NFL because Kelso looked like a major geek with this helmet.Part of it is based on academic grounds. Among major conferences, the Pac-10 is the best academically, largely because of Stanford, Cal and UCLA. “Colorado is on a par with Oregon,” he said. “Utah isn’t even in the picture.”
