    Interesting Costco Lawsuit

What do you lawyers and other intelligent people think? I'm not asking for your common sense opinion, but your legal opinion.

Costco had better hope he'll settle for cheap.

I hope he wins the lawsuit. That is one thing that I really hate about Costco.

I hate that other stores do that now, including the greeter at Walmart.

The greeters do that now? I haven't seen that yet.

They do in my neck of the woods. They're selective about it though. They profile like TSA.

From a legal perspective, I imagine Costco will assert some kind of shopkeeper's privilege. Is that reasonable based on not showing a receipt? Interesting question considering the customary practice at Costco. I'm not sure what the customer argues for why he got physical with the employee. Maybe false imprisonment?

I don't like the receipt checks either.

The guy started the altercation. I think that makes it his fault.

I'm pretty sure $670,000 won't stop Costco from doing it.

Hopefully the jury will tack on a few million in punitive damages. Then the judge will double or triple them.

I don't get involved with torts and personal injury, but I could see this going either way, depending on eyewitness testimony, and there has to have been multiple eyewitnesses. But yeah, Costco will want to keep this away from a jury that will be anxious to put an end to The Walk of Shame or The Final Indignity, as it's been variously identified. I can see a jury instruction telling them to disregard that practice, as it may not be relevant for purposes of finding fault with the specific harm in question.

Why do they check the receipts? Seems the threat of theft is low since they pretty much help you through the checkout line. It's not like people are hiding TVs in their shirts.

We cannot expect to experience the blessing of faith by standing inactive on the sidelines any more than we can experience the benefits of health by sitting on a sofa watching sporting events on television and giving advice to the athletes. I always thought the membership card and receipt check was pretty much a psychological gimmick designed to make people feel like they're getting great deals as part of an elite club.

The military guy went overboard with the physicality, but how difficult is it to allow the lady to draw a line on your receipt? Guy sounds like a knucklehead.

It says they grabbed the cart. I don't see how that's false imprisonment, unless the cart somehow becomes an extension of his body.
