judges subject to reappointment or reelection pander and do dumb shit. it's simple. roberts is the perfect example of why lifetime appointments are not a step that can be skipped.Originally posted by Northwestcoug View PostGonna need a little help with this one. So make SC terms fixed? Lame Duck justices who have to hurry and make their mark before they are off the bench? No thanks.Originally posted by Northwestcoug View PostSo make SC terms fixed? Limiting the terms of the justices would run counter to separation of powers. It would undercut the power of the judiciary.Give 'em Hell, Cougars!!!

Instead of letting them essentially become lame ducks by their age, and going out with a bang before they retire? I don't see why it wouldn't happen in either scenario.Originally posted by Donuthole View PostLame Duck justices who have to hurry and make their mark before they are off the bench? No thanks.
I don't see how limiting SC justices to fixed terms undercuts separation of powers. The SCOTUS as a body is still theoretically equal to the presidency and legislature. Am I missing an argument?Originally posted by myboynoah View PostLimiting the terms of the justices would run counter to separation of powers. It would undercut the power of the judiciary.
Again, it's not a panacea. I'd rather do term limits, but what about some baby steps? What about a mandatory retirement age? Canada's SC justices retire at 75."...you pointy-headed autopsy nerd. It would give the executive branch (primarily) and legislative branch (secondarily) greater power and influence over the judiciary because there would be opportunity to stack the court based on the latest political whims.Originally posted by Northwestcoug View PostI don't see how limiting SC justices to fixed terms undercuts separation of powers. How does that fix the appointment issue? All it does is make it obvious when the next appointment will come. See least now you don't exactly when a justice will die and a shot will open up. Could be during Trump's term, could be during Biden's. Could be neither.Originally posted by Northwestcoug View PostI'd rather do term limits, but what about some baby steps? Why is it that people want term limits when their party isn't in power?"Discipleship is not a spectator sport. We cannot expect to experience the blessing of faith by standing inactive on the sidelines any more than we can experience the benefits of health by sitting on a sofa watching sporting events on television and giving advice to the athletes. And yet for some, “spectator discipleship” is a preferred if not primary way of worshipping." -Pres. Uchtdorf
