      The ironic thing is that today's DACA decision is, in many ways, something that conservatives have been calling for for a long time. It is an enforcement of limitations that Congress has enacted on the ability of the administrative state to change the law on a whim. A relatively strong application of the APA will be a burden on liberal administrations going forward just as much as it has been on the Trump administration. It is still way to easy to make significant changes in the law through administrative rule making and executive order, but it is a little hypocritical for both the conservative wing of the Court to be crying about a decision that limits the Trump administration's ability to repeal DACA without justification and the liberal wing of the Court's eager applause for putting restrictions on the administrative state. Roberts seems to be the only one that see the long term repercussions of this.

        Obama's stand on immigration was one of the few things I liked about his agenda. DACA was a great thing, but I wish he had implemented it through Congress when he had both houses. His "I have a pen, and a veto" comment furthered the path of executive overreach that we've been on for years. Fortunately, Trump isn't even smart enough to get that right.

              I wasn't much of a fan of Obama's immigration. Of course I'm its biggest fan compared to the dumpster fire going on right now, but at the time it was nothing to write home about and certainly disappointing. However, DACA was explicitly supposed to be a bandaid until Congress passed the DREAM Act. That's how Obama outlined it-- probably explaining why he didn't do it correctly; it was never meant to last forever or be something that would even need dismantling. Who would have thought that 8 years later we still haven't done jack shit for Dreamers, even though > 85% of Americans are strongly in favor of a path to citizenship for them? Embarrassing.

                I used to live in . . . well, now the Creek Reservation. This decision is remarkable. Probably right on the law, but you could usually count on judges to squint if doing what the law said would hurt too much. It will be interesting to see what comes of it.

                    The quote from Robert's dissent seems like he feels it will lead to much more than jurisdictional issues for prosecutions:

                    “The decision today creates significant uncertainty for the State’s continuing authority over any area that touches Indian affairs, ranging from zoning and taxation to family and environmental law.”
                    Could just be a slippery slope argument, though. I haven't read the actual opinions.

                        I had to write a summary for my CEO. outside of Indian crimes under the major crimes act, this is a big fat nothing burger. But Gorsuch did pontificate on tribal sovereignty in a manner that wasn’t necessary to decide the case. Oklahomans are scared because they’re a little racist.
