The Supreme Court, bastion of conservatism

Well basically the surrounding counties will now be responsible for providing all the basic services that Disney is providing now and that a county normally provides. Which will require massive investment and a big tax hike. I think the special district gets put back in place before that cost every actually gets shifted to the counties.

And the county will be able to tax Disney to pay for the services. I'm not sure who is getting the better end of hte deal but Disney doesn't really seem enthusiastic about giving up the obligation to perform those services.

The problem with the Supreme Court is not that it is conservative per se. But that it has made itself too important. It should not be the center of attention. It should not be controversial. Most Americans shouldn't even need to think about it most days. These nine people should not have so much power and attention. It's a reaffirmation of democracy that this wholly undemocratic institution is so badly in need of reform. There should be many more justices. I'm not talking about court packing. There should be many more justices without regard to politics. There should be panels. There should be reasonable term limits. 12 years? There should be a code of ethics (they have none. What rule did this leaker violate?). Their deliberations shouldn't be such a black box. These towers of abstractions they build on the Constitution are arbitrary and confusing and sometimes or often ridiculous. They should be more grounded in the facts and decide cases individually on the facts or public policy. There really is no reason the Supreme Court should function any different than the Courts of Appeals or have much more attention drawn to it.

Isn't there an argument that the SCOTUS striking down Roe is basically forcing the other branches of government to do their job? Without and explicit (or even mildly implicit) right to abortion in the Constitution, it's the Legislature's job to make such a law. Congress has ceded power to the President through the various acts that allow him to do way too much adn they've ceded power to the courts to create Constitutional rights and laws where none exist.

With this argument, SCOTUS is basically saying "do your job, Congress" or they are telling us voters that out senators and representatives might actually be important after all.

Carrying your argument to its logical conclusion, the Supreme Court should not have issued Roe in the first place. I said that this problem of a Supreme Court gerontocracy isn't necessarily about it being conservative or liberal. There was certainly a third way, a less categorical approach to this problem that would have been more democratic and less divisive.

I don't see how reforming the Court to make any individual less powerful and more democratic would inhibit its traditional role of protecting from the tyranny of the majority. They wouldn't be elected. The Supreme Court has become as political as the Senate. A mirror of the Senate.

Gone are the days where they committed to vote 9-0 on the Nixon tapes whatever the outcome. I lost faith in the institution when they voted on the 2000 election 5-4 along party lines. I was disgusted at the politics, not the outcome.

The problem is that the Supreme Court needs to be a referee. Not part of the crowd.

Finally, I'll note that until the 1050s the Supreme Court was the bearer of almost exclusively vile decisions that limited individual liberties. Upheld school segregation, Jim Crow, eugenics, slavery. The majority of Supreme Court history is a disgrace.

This would result in many more Supreme Court cases too. So more due process and more work for lawyers.
