  • Same-sex marriage coming to Utah

    Utah federal judge rules Utah's constitutional provision reserving marriage for only a man and woman violates the U.S. Constitution’s guarantees of equal protection and due process.

    "The state’s current laws deny its gay and lesbian citizens their fundamental right to marry and, in so doing, demean the dignity of these same-sex couples for no rational reason," wrote U.S. District Court Judge Robert J. Shelby. "Accordingly, the court finds that these laws are unconstitutional."

      This is what will happen on a nationwide level. The Windsor decision laid the ground for this and ultimately the Supreme Court will hold similarly.

        Good. Time to pack up and move on with this issue. No one can reasonably think this is not inevitable countrywide.

                FB starting to blow up, as expected.

                Can one of you legal experts weigh in here? Does this mean that Utah has to start recognizing gay marriages from other states, or does it mean that gays can now get married in Utah? Because if it is the latter, holy cow...

                          Shelby said the state failed to show that allowing same-sex marriages would affect opposite-sex marriages in any way.
                          It was unclear what the immediate effect would be, because the state can still appeal. The Utah attorney general's office said it would issue a statement on the ruling later.
