      Whenever I have federal orders, it says "with consent of the governor..." The governor trumps the president, and the ranking officer in the state national guard is appointed by the governor.

        I seem to remember when Trump wanted to send National Guard to the border several governors said not from their state, and that was it.

          If the President "federalizes" the National Guard for a war or official national emergency, he can overrule a governor. Otherwise the governor can overrule him.

            Federalization refers to Title 10 orders in support of contingency operations that have been authorized by Congress. I'm not positive what the President can do with respect to the National Guard without any specific congressional authority already in place. He can probably call us up for 60 days.

            To go along with that, my Title 10 order when I went to Iraq did not have those same words "with the consent of the Governor of Utah", where my current Title 32 orders do say that.

            If push comes to shove, it's a constitutional crisis no matter how you slice it.

            • There are also the existence of “state guards” which are under no federal control whatsoever. About half the states have them. Seems like they are there for disaster reasons and I’m not sure if they are armed although I suppose they could be if needed.

                Yeah, the one we had in Utah was a joke. It's an interesting concept, but I doubt that any state will spend the money to make them serviceable or even "well regulated", at least not in the near future. Perhaps if we moved away from the behemoth centralized government we have at the federal level things would change.

                        • They take care of ecology. Is it bad? I only ride my bike because I feel sorry for our planet. The ozone layer is getting weaker every year. Unfortunately, I haven't saved up enough money to buy an electric car yet, but I have such plans. I invest in cryptocurrency. I believe that in a few years these investments will float themselves.
