    The latest case in point: CNN's Chris Cuomo was dissecting the latest Wikileaks document dump when he decided to "inform" viewers that it's illegal for anybody but a member of the media to download and view the contents of the Podesta leaks:

    "...Remember, it’s illegal to possess these stolen documents. It’s different for the media. So everything you learn about this, you’re learning from us."
    Yeah, that's not how the First Amendment works. Legal precedent has repeatedly made it clear that the First Amendment offers the same protection to the press as to the public, even when it comes to possessing or distributing illegally obtained material (just as long as you weren't directly involved in the theft of the material in question). In its 2001 Bartnicki v. Vopper decision, the Supreme Court rejected even civil liability for distributing illegally obtained cellphone recordings, and refused to differentiate the public from the media in its ruling:

    "The . . . question is whether the application of these statutes [that purport to ban distributing illegally obtained material, even when one wasn’t involved in the distribution,] in such circumstances violates the First Amendment. [Footnote: In answering this question, we draw no distinction between the media respondents and Yocum.]"
    As the Washington Post and the Wall Street Journal's law blog were quick to highlight, that case cited New York Times Co. v. Sullivan, which also treated press outlets and the public equally in the eyes of the law in such situations. The Supreme Court's Pearson v. Dodd ruling also makes clear that the possession of illegally leaked materials is simply not treated the same way as knowingly possessing physical, stolen property.


    This isn't Cuomo's first run in with being violently wrong on legal fundamentals despite having graduated from Fordham with a law degree. He also took a bit of a beating last year when he apparently hallucinated a "hate speech" exception buried in the First Amendment. At some point you have to wonder if CNN is actively trying to be this bad at what it does, or if CNN boss Jeff Zucker is a subversive artist of the highest order, working tirelessly to craft a crushing, satirical look at modern American intellectual dysfunction.

    CNN "Loses" Satellite Feed Just As Republican Congressman Mentions WikiLeaks

    In yet another coincidentally-timed "technical glitch" at CNN, Republican Congressman Chris Collins was cut off within seconds of mentioning "WikiLeaks." Per InfoWars, Collins joined a conversation with CNN's Chris Cuomo and immediately went on the attack against Hillary. But as soon as he utters the word "WikiLeaks" his feed is suddenly "lost."

          • Utah: Trump vs. Clinton vs. Johnson vs. Stein vs. McMullin

            That CBS/YouGov poll is a definite outlier. When it scrolls out of the calculation after 2-3 more polls Utah should definitely go into the toss up category, and eventually Leans McMullin after even more polls. What color will McMullin get?

                      They used a different methodology than the others. They only gave the option up front of choosing Trump or Clinton, but then only if the respondent wanted more choices did they ask about the others. Totally dumb way of doing it in a state that has an independent candidate with support. Also, it doesn't mirror the actual election ballot at all. It's not like in the voting booth you're going to have to choose "other" before it takes you to a separate page to see the other choices.

                        Yes, that explains the yougov poll, dumb way to ask the question given the circumstances.

                        It's two and a half weeks before the election, McMullin is probably going to win the state given the trajectory.
                        Part of it is based on academic grounds. Among major conferences, the Pac-10 is the best academically, largely because of Stanford, Cal and UCLA. “Colorado is on a par with Oregon,” he said. “Utah isn’t even in the picture.”

                        • On MSNBC yesterday afternoon they were talking about Trump having trouble in Arizona and how he'll probably lose there now. The host asked Steve Kornacki, the analyst, what was going on there and he said he thinks it's the Mormons: "you see what's happening in Utah and I think it's spilling over into Arizona." There was a poll in Idaho from earlier this month that showed Trump only up 10 points when he was up by 20 in the same poll in August. And that poll went for a couple of weeks, so some of the response would have been from late September. I think it's likely even closer there now. Imagine if Trump gets beat in Utah, Arizona, Idaho, Nevada, Colorado....That would send a message to the GOP from the most reliable voting bloc they've ever had to nominate a real candidate next time.

                            I think going forward it is going to be even more difficult for the republicans or anyone except a democrat to win the White House.

                            Based on so called principles, evangelicals stayed home and wouldn't vote for Romney. Based on principles mormons won't vote for Trump. So many contrasting principles within the republican party.

                            As for the democrats and most of the press, ideology is more important than so called principles (IMHO).
