All that options does is change the time frame it has the same problems as no amnesty. It still gives the rapist a tool to silence his victim. It is just the victim gets to wait for the legal process to play out until she has to deal with the honor code.

The problem, as I see it, is that amnesty just isn't a real option. I don't see any reason why the school should look the other way about a serious infraction of the school's Honor Code, which as we all know, the student agreed to abide by, just because the infraction coincided with a horrible event in the person's life. Being a victim of a crime does not absolve one of responsibility for their own actions.

I can, on the other hand, see how it would be needlessly insensitive to pursue a full-scale Honor Code investigation at the same time the victim is struggling through the criminal justice system. Your solution simply gives the victim a free pass just because the thing that was done to them is worse than the thing they did. This shouldn't be a balancing act of which wrong was worse.

Certainly there are normal people who do depraved things because of outside influences. And, there are laws that seek to punish those pathological outside influences (selling alcohol to minors, inciting to riot, etc.). I'm not saying that the HC needs to be punished legally, but when something causes people to break the law in depraved ways that they likely would not do otherwise, then something is amiss and needs to be rectified. Render unto Caesar what is Caesar's....the HC should be about academics and campus life. Let the spiritual stuff be between the student, God, and his/her judge in Israel.

That's like saying marriage vows cause people who commit adultery to lie about it.

But that second part, I'm totally with you.

As long as the victim is a victim, and not lying about it, they should have nothing to worry about. Even if it's a push, and turns into a he said she said, set the evidentiary level high enough for the HC Office to only take action against those who are likely lying.
