Yeah, but it was a total accident.
If we disagree on something, it's because you're wrong.

This thread could have the potential for some pretty awesome stories.

I had a summary judgment hearing once in a case that I trust will be of no interest to anyone here. The judge did not ask me more than a question or two during my argument; we was nodding the entire time. When the other side got up the judge gave him the business for making the arguments he did. He ended with a meek statement that he was just doing what his client told him to do. When it was time for my reply, I stood up and whispered to my co-counsel, the managing partner of our office, “Watch this.” My argument consisted of placing a single document on the projector, staring at the image for about ten seconds, and saying, “I’m happy to answer any questions the court may have.” It has none. We settled the next day.

This was, I think, in the second year as an associate with the firm.

I have drop the mic moments all the time. Unfortunately, they all come 5 minutes after the argument or confrontation ends

Still haven't seen that used in court. Aren't your exhibits scanned/submitted electronically to the court beforehand?

Elmos don’t require anything electronic. It just projects whatever it ‘sees’ onto a screen/wall or whatever. They are easy to use.
                    PLesa excuse the tpyos.

Right. Effective for situations where witnesses or jury members need to see exhibits. But not something often used in an MSJ hearing where the judge presumably has all of the documents already attached to the briefs.

I know what an ELMO is. I've been to parent teacher night.

This was one of those cases where there are hundreds of pages of materials necessary to set the stage but the outcome turns on two of them. I could have suggested that the judge turn to page 13 of exhibit BBB, I suppose, but it seemed a little more effective to just put it up on the screen.

Sorry for misunderstanding. But in my defense I didn’t know what you really were asking is why was he using it in an MSJ hearing because that’s not what you said.

                              No problem. I forgive you.
