Yes, and I thought when fusnik mentioned "FB" to me several times during last week's golf fest he wanted me to be his friend on Facebook.

Arguments made on an internet message board aren't the same things as legal arguments in criminal prosecution. I'm not sure why you're conflating the two.Originally posted by Jeff Lebowski View PostGood lord, what a post. I hardly know where to begin...
Let's try this: Based on your logic it would seem that the hotness of the teacher should have a bearing on the eventual judgment and ruling of the case. Suppose that we still had the same sexes and ages, but the teacher looked like this instead:

Different ruling, right?
I would LOVE to see a defense team make the argument you are making. That would be awesome to watch.
While you're in a rush to equate women over 30 having sex with 17 year old boys and men over 30 having sex with 17 year old girls, just consider the fact that men can be convicted of sexual assault when both he and the female victim are equally intoxicated and he's just as unable to make an informed consent to sex. The law in that regard seems perfectly willing to disregard notions of pure gender equality. So, if you're going to make the idiotic "what if the roles were reversed" comment, then you need to be prepared to defend those kinds of rape prosecutions. I'm prepared to actually say that women and men, and it extends to teenage girls and boys, have vastly different emotions about sex and it affects them in dramatically different ways. The role-reversal argument is the hobgoblin of little minds. I say the same thing arguments about slippery slopes and blind appeal to authority.
Just to avoid confusing you even more, no I wouldn't make this observation a centerpiece of my closing argument. The law is written as it is, and even though I'm certainly no criminal defense lawyer, I can't imagine you'd be doing your client any favors by basing your defense on attacking the underpinnings of the law they've violated.Part of it is based on academic grounds. Among major conferences, the Pac-10 is the best academically, largely because of Stanford, Cal and UCLA. “Colorado is on a par with Oregon,” he said. “Utah isn’t even in the picture.”

This nice couple taught at the high school here.
A Madison County grand jury indicts former Ridgeland High School girls softball coach Mike Porter and his wife in a sexual battery case involving a student.
It's been a mess for our schools. The mother of the girl involved was an employee at the school. Everyone knows who the girl involved is. The principal was fired over this. And this young couple with a new baby will likely never work again. It's crazy to me. I am trying to imagine a thought process where bringing a minor into your marital relations seems like an OK thing to do.What's to explain? It's a bunch of people, most of whom you've never met, who are just as likely to be homicidal maniacs as they are to be normal everyday people, with whom you share the minutiae of your everyday life. It's totally normal, and everyone would understand.

I have never understood why people say "rape isn't about sex, it's about power and control" or however the saying goes. Do people really believe that?Originally posted by Donuthole View PostAlso, if sex crimes aren't about sex for predatory men, why would they be for predatory women?
That seems like the type of idea that a feminist woman would come up with because a) women can't understand the appeal of rapey sex to men and b) they view the entire world through the lens of gender conflict and men exercising power over women.
I think rape is about the sex. In a world where bad guys occasionally steal everything else by force, why would sex be any different?

You are right that there are certain cases where gender matters. This isn't one of them. Yes, of course you wouldn't make "it's-cool-because-he-is-a-dude-and-she-is-hot" part of a closing argument. You also wouldn't include it in a plea for leniency at sentencing. You wouldn't bring it up in jury deliberations either unless you want to look like an idiot. And you sure as hell wouldn't try to use it as a basis for changing the law because it is patronizing and sexist and would be shot down in a heartbeat. I hope that's not confusing to you.Originally posted by Color Me Badd Fan View PostArguments made on an internet message board aren't the same things as legal arguments in criminal prosecution. Unless sex for you is normally about power and control, in which case you are fairly rapey, rape is not about the intimacy or pleasure. Pretty sure it's about the perpetrator feeling consummate control, and there is ample psychological study to confirm this.Originally posted by CardiacCoug View PostI have never understood why people say "rape isn't about sex, it's about power and control" or however the saying goes. Well, first let me say that I was being partially facetious with that post, because I think there is a distinct difference between "consensual" sex with someone underage (yeah yeah, statutory rape isn't legally consensual, but it is often literally consensual, like in this case) and forcible sex against another's will. There are levels of perversion, and while a 36 year old who has "consensual" sex with a 17 year old is certainly perverted, that person is, at least in my mind, significantly less perverted than someone who would force themselves on an unwilling participant.Originally posted by CardiacCoug View PostI have never understood why people say "rape isn't about sex, it's about power and control" or however the saying goes. And I agree that in many, many cases of what is legally defined as rape, it is 100% about the sex. I'm talking about those "no, no, ok I guess, oh now I feel guilty" cases where the woman shows some initial hesitance before ultimately consenting and participating in a manner which can reasonably be interpreted as consensual, only to later claim the sex was 100% against her will. That kind of "rape" is absolutely about sex.
But I think the statement that rape isn't about sex is probably true when we're talking about actual forcible rape. Of course, that is an interpretation through the lens of someone who would find zero arousal or enjoyment in engaging in sex against another's will. Perhaps violent rape is about the sex for someone so perverted to even consider the act, but that's kind of impossible to understand through a normal lens.
As for your theft analogy, i don't think it's very sound. If someone steals your iPhone, they can sell it for cash and get what they want. If they rob a bank, they get cash. Cash isn't damaged or imperfect, and it's the same thing they would get if they worked an honest job. They just found an easier way to get the same thing.
However, if man forcibly rapes someone, he is not getting the same sex he would get if he came by it honestly. Sure, he may steal an orgasm, but he could get an orgasm with a porn site and some lotion if the orgasm is all he is after. Which is why I agree that forcible rape isn't about the orgasm and isn't about the sex. A thief wouldn't rob a bank if he knew he was only going to get counterfeit bills.Prepare to put mustard on those words, for you will soon be consuming them, along with this slice of humble pie that comes direct from the oven of shame set at gas mark “egg on your face”! -- Moss
There's three rules that I live by: never get less than twelve hours sleep; never play cards with a guy who's got the same first name as a city; and never go near a lady's got a tattoo of a dagger on her body. Now you stick to that, everything else is cream cheese. --Coach Finstock
