        Did the other guy throw the first punch? Sure does look like it. So the Old man goes off on him and takes him out.. WOW..

        The old man walked up front to get away although still talk trash, but you just leave it alone..


        That is why I read my book and don't talk to anyone when I ride my bus...

          I think it is pretty safe to say that I would never throw a first punch, and in most confrontations I would not throw the second punch either (I would remove myself from the situation). Would I say something that might set off a loose cannon? Perhaps.

                      Why are people saying it is sad? He put his hands on the guy. No one made him do it. I don't have the least sympathy for him.

                      I have probably shared this before but one of my local judges has what he calls the "VFW" rule. Two guys are arguing in a VFW and one of them decides he is going to leave and walks out the front door. Then he decides that his ego can't take than and he walks back through the door and starts running his mouth some more. The other guys says nothing and cold cocks him. Punch thrower is acquitted because "if you go looking for trouble and you find it, you got what you deserved." Not exactly a clean legal theory, but there is a lot of common sense to it.

                        Sad, not that the guy kicked his ass, but that is the outcome that most wanted, egged them on to it. it was a very just outcome, sometimes you just wish stuff didn't have to happen, and this certainly didn't.

                              In this case it was the old dude who was looking for trouble. He was instigating like crazy. He starts by provoking with racist language. Then, as he is walking to the front of the bus, he dares the young buck to make good on his feeble threats. He continues to taunt him from the front of the bus. The young kid's pride is on the line. He is smaller and obviously out of shape, but he is being egged on by both the old man as well as the other women in that area. He makes a poor choice, throws a glancing blow that barely touches the dude's chest (not his face, as the old dude indicated), and the old man brutalizes him.

                              Looking at your analogy, the old man walked out the front door of the VFW, but instead of leaving the situation alone, decided to continue and taunt the young punk. The young punk threw the first punch, but he was seriously provoked. If he had kicked the shit out of the old man this would be analogous to your VFW story, but it turned out different.

                              If you are a big strong fighter, and you get on a bus and invite a young black dude to spit-shine your shoes, and then the young black dude calls out your racism and indicates that he would like to give you the ass-whooping you deserve, and then you basically call him a wuss and dare him to try it, and after he backs off you continue to taunt him... when a fight breaks out, even if it is the small young unfit guy who throws the first punch, who is the real instigator?
