Yeah, they can. (read disclaimer below) Usually this occurs when the beneficiary murders the decedent in order to get the insurance money. The courts often create a fiction (or by statute) where the insurance proceeds are placed in a "constructive trust" and the funds are then distributed to the decendent's non-murderous heirs. Perhaps this is what the Cox family is trying to do--at least for the boy's insurance proceeds, since they are likely intestate heirs to the boys' estate. It doesn't seem right that the murderer's heirs benefit from his heinous acts.
