I figured he'd win his appeal because of the language in the waiver. The NCAA denied him because it violated the spirit of it. No way would that defense hold up on appeal. They need to do away with it altogether.

A buddy of mine made a good point the other day, the NCAA has zero control over the national championship, BCS, conferences, tv deals, money etc. So the small things that they do have control over they micromanage the shit out of them and play hard ball to try and throw what little weight around that they have.
