    150 Years for Madoff

Read all of the details here.

The man is a bad dude, for sure, but is the sentance commensurate with the crime? Should he have gotten more? Less?

He was ordered last week to pay off 171 billion, so it looks like there shouldn't be any money coming his way.

His wife was left with 2.5 mil, but they are being forced into selling all of their property, Manhattan penthouse, Florida real estate, etc.

There's no way he's going to serve the entire sentence. That just isn't right.

This quote from the article is interesting. I wonder what this sort of all alone-ness would be like:

But in meting out the maximum sentence, Judge Chin pointed out that no friends, family or other supporters had submitted any letters on Mr. Madoff’s behalf, attesting to the strength of his character or good deeds he had done.

Even Mr. Madoff’s wife, Ruth, whose own awareness of his business dealings has been a major unanswered question, issued a statement on Monday distancing herself from him.

“All those touched by this fraud feel betrayed, disbelieving the nightmare they woke to,” she said. “I am embarrassed and ashamed. Like everyone else, I feel betrayed and confused. The man who committed this horrible fraud is not the man whom I have known for all these years.”

She was not in court for the sentencing hearing.

I think he deserves the death penalty.

His whole case reminds me of the great Tom Wolfe novel, "Bonfire of the Vanities". If you haven't read it you should. Great book, crappy movie.

Federal sentences are brutal. He may get out after 149 if he behaves himself.

I have a friend who lost a small fortune his scheme. He IM'ed me this morning when the sentence was announced. Here is the brief exchange:

                Buddy 8:48:55 AM: madoff - 150 years
CJF 8:49:53 AM: It's is about 400 years too short.
Buddy 8:50:12 AM: actually its about 50,000 volts too short

That would be quite a precedent. Who after that fries? Alan Stanford? Rick Kroeber? Is there a monetary value where this cuts off?

                      I don't really give a shit.

Scumbags like that, who're already at an advanced aged and are "sentenced to life" should fry. Leaving them to rot in prison isn't much of a punishment as far as I'm concerned...and if they are gonna do that,,,then put them in a hard labor camp and make them pound rocks til they keel over and die.

No one is frying for any crime besides murder or treason any time soon. Georgia (I believe) tried to impose the death penalty for a rape conviction and the Supreme Court held that the penalty was grossly disproportionate of the crime (rape of an adult). Louisiana then passed a law that imposed the death penalty for the rape of a child. The Supreme Court stepped in last year and held that, again, the penalty was disproportionate and violated the eighth amendment. They basically said that if the crime doesn't involve a death, then the death penalty is too extreme of a punishment. I'm not sure when the last time someone received the death penalty for treason and I wonder whether the SC would allow a penalty like that to stand.
Part of it is based on academic grounds. Among major conferences, the Pac-10 is the best academically, largely because of Stanford, Cal and UCLA. “Colorado is on a par with Oregon,” he said. “Utah isn’t even in the picture.”

Oh, I'm fully aware of where the death penalty line has been drawn, I'm just interested how far people are willing to go. I don't expect there to be the death penalty issued for white collar crime anytime soon.

On a side note, I seem to remember there being a rather recent case where the death penalty was ordered for a case of treason. Off the top of my head I just can't remember who it was, but maybe it was just a life sentance. I might have to dig around a bit for that.
