  • Boston Bombers: Murderers or Terrorists?

What are they charged for? How will the Feds go after them to prosecute them...as murderers or terrorists?

Just listened to a video where one fellow was saying they were more like the Columbine kids than terrorists and they should be prosecuted as murderers and not terrorists.

    Me? Terrorists.

    Thoughts?

Bombs are illegal already. Are you for the legalization of bombs? Do you need them for hunting? Or for protecting your home from burglars?

So if the item is illegal, then you can blame the perpetrator. If it is legal, then you blame the legal instrument and the perpetrator is off the hook? Doesn't make sense to me, but I will think on it.

Given bombs are illegal then it must be the fault of the bomber. So if guns were illegal then would it be the fault of the shooter?

Or one is already manufactured and readily available, whereas the other requires the motivated individual to manufacture one of their own.

Sounds right to me, except why when a drunk kills someone with his car is he blamed and not the car?

We should make cars illegal so things are somewhat consistent.

They are both murderers and terrorists. US citizens deserve ALL of the protections of the Constituion including the rights to remain silent, to representation, to a speedy and fair trial, to not be subject to cruel or unusual punishment, and to an arraignment hearing. He also should be confined in isolation for his own safety.

We are America; he is a citizen: the murdering son-of-a-bitch deserves the rights he would deny us.

Either way they should be tried as US citizens and be read miranda rights. But really the Bill of Rights doesn't exist anymore anyway.

Yes, but given the ink on his citizenship isn't dry yet maybe he should just be shipped off to Gitmo. It is a good thing that Obama didn't shut down that place. You never know when we are going to need it.

What?? I didn't go out bomb and kill people. Why does he deserve the same rights I have? He will get his trial and have a lawyer and have a bunch of apologists like I heard on Sunday talk shows. "We really need to find out what we do to alienate or not assimulate these people who come here".

I don't believe he deserves the same rights as me or the sames rights as a guy picked up for smoking pot.

I agree. Read him his miranda rights in a couple of months.

I'm not following the Miranda rights controversy. I'm thinking they likely have enough evidence to prosecute him without needing his confession. Is he giving information to the authorities without having his Miranda rights read first?

Now, I'm not a criminal attorney, but Miranda rights aren't necessary for arresting someone. They're necessary for questioning someone in custody.

It seems he's not being interviewed and providing information in writing. Is there any reason to believe the investigators didn't read him his Miranda rights before they started questioning him? Seriously, what's with all the concern over his Miranda rights?
If we disagree on something, it's because you're wrong.

Because we are a civilized people. Either we are all equal before the law, or the Constitution of the United States of America is an old piece of toilet paper. He is a citizen, whether by birth or recent adoption; he has rights the same as any other citizen, rights so important that we wrote them down and made them the law of the land. The rights are the same for what he did and the pot smoker; the punishments will not be.
