      Seven of the nine Supreme Court Justices were nominated by Republican presidents. It would be a huge mistake for Obama to not take the opportunity to balance the court. Supreme Court Justices are supposed to be impartial, but we all know it is impossible to be completely impartial.

        Bush I screwed up and nominated a liberal to the court. Obama is constantly talking about fixing Bush mistakes. Perhaps this is one he could also fix.

          Well I'm crossing my fingers that we get a stealth conservative. Heaven knows that there have been a number of stealth liberals, Souter first and foremost among them.

            Don't count on it. Byron White made it on the court almost 50 years ago and the Dems aren't going to repeat it. I think Obama is going to zing a real radical in there the first go around. He'll likely place three justices on the Court by the end of his first term.
            Part of it is based on academic grounds. Among major conferences, the Pac-10 is the best academically, largely because of Stanford, Cal and UCLA. “Colorado is on a par with Oregon,” he said. “Utah isn’t even in the picture.”

              Yeah, in addition to Souter, Stevens needs to get the hell out of there so more balance can be brought to the court.

                  Yes, and Ginsberg's health has been poor. I would assume that any liberal justice wanting to step down will not only do it during the first term, but will do it before the 2010 fall elections to ensure that confirmation of the new nominee takes place in a Senate that is about as heavily weighted to one party as it has been in a great while.

                  This will be very interesting, because it provides both parties an interesting sidelight at a time when there is cause of discouragement on a number of fronts. For Republicans particularly, if a very liberal justice is nominated, it will afford a nice opportunity to energize the base. My guess is that Obama, at least on the first one, will go with someone like the chief justice, only more liberal. That is, someone who, though he/she may not be their first choice as an ideolog, is so well respected and imminently qualified that there would be real political risk for the opposition in jumping up and down too much.

                    Supreme Court nominees are often brought up from one of the circuits, and I'm betting on Ninth Circuit Justice Jay Bybee as Souter's successor.

                          The appointments to the SCOTUS was actually one of the things that gave me major pause when I stepped in the voting booth. The prospect of Obama appointing some off-the-deep-end liberal judge scared me. I think so far he has shown his appointments to be more pragmatically based on qualifications then on friendships or purely political calculations.

                          The word on the street is that it's most likely to be a female as the fairer sex is poorly represented among the SCOTUS. The three big names that appear to be the candidates leading the pack at this admittidly early stage are Elena Kagan (currently going through appointment in another position and a former Harvard prof.) Diane Wood (sitting as a judge in the 7th circuit and with Chicago ties) and Sonia Sotomayor (also a current judge with the 2nd circuit, would be the first Hispanic appointed to the bench).

                          The Supreme Court appointment has become increasingly important as more and more political battles are ultimately fought there. Even if Obama were to appoint a die hard liberal to the bench it wouldn't change the composition of the court by much, as Souter almost exclusively votes in the liberal block of the court. Expect a pretty big fight, or at least a lot of screaming from Rush and all of the other talking heads out there.
