Wanna know something interesting? Let's pretend this is true and he was underage when the woman was legally an adult. The whole point of saying that someone is "underage" for consent to sex is that they are deemed to lack the maturity to make a decision in regards to the costs (risks) and benefits associated with engaging in sex. Sort of like not being able to sign a contract for buying a car, or getting your ears pierced without parental co-signing or consent.
