I guess you could read it and that if you had consent you are free to continue, but that requires a believe that consent isn't continuing.

I realize practically no one is going to be prosecuted if they have consent, the woman passes out, and they decide to keep going for a short period of time.

That how I would argue it. I don't see any provision that requires a person to continuously verify consent. Wouldn't that apply to normal, non-inebriated sex as well? "You still okay with this? Still? How 'bout now? Can I keep going? I'll just ask before each thrust."

Pretty sure that one thrust isn't technically sex so I'm going to say, not rape

We cannot expect to experience the blessing of faith by standing inactive on the sidelines any more than we can experience the benefits of health by sitting on a sofa watching sporting events on television and giving advice to the athletes. If you have a previous sexual relationship and decide to have sex with her while she unconscious is that rape?

If you are having sex and a woman says no to continued sex, do you get a couple of thrusts before you comply?

You have argued the consent is continuous. If I understand your argument, anytime a woman passes out, consent is automatically withdrawn. What if the woman passes out for a few minute then wakes up in the middle of the act and is fine with it? The dude was a rapist for a minute or two?

Its just an absurd line to draw. Plus, you've already admitted it will be impossible to enforce and completely impractical.

That's been my line. "Sorry, it was just one poke - the law gives me that much, baby!"

Good point. How is auto-erotic asphyxiation handled?

                  • It's the leading story on CNN.com right now, so lots of people are talking about it. I welcome the awareness.

I don't know the scope of sexual assault/abuse at BYU, but I do know that it's a huge problem in our society, and even within our Mormon culture. I know too many stories and people that this has affected. I applaud Funk for his passion. It's obvious he doesn't have all the answers, but none of us do. I think awareness and discussion is a great start. I'll stop short of applauding the direction of this particular discussion.
