    HOA question....

Can the CC&R's truly be enforced? For example, if I paint my house yellow and install a fence in my front yard can I really get in trouble? If levied a fine for disobedience to the HOA can I not pay and sue if they lein my home?

You can get in serious trouble with anyone that has any decorating taste if you paint your house yellow.

      yes
      yes
      yes but you won't win

They can force the sale of your house due to nonpayment of fees and assessments.

Dont mess with your HOA. No one is as petty, dictatorial, and with a long grudge memory as HOA officers.

They can be, what will most likely happen is they will fine you and put a lien on your home, so if you ever try to sell it you will have to pay that with the proceeds.

I've heard that it depends on where you live.

Here in Utah, the HOAs are pretty powerless.

From what I understand, all they can do it put liens on your property. So unless you are refinancing or selling, they can basically do nothing.

I've heard that the towns are more of an issue than an HOA in Utah. For example, my wife's cousin in Springville could not get approval for a two car garage from the housing folks in Springville...but it wasn't their HOA.

Well, because he thought it was good sport. Because some men aren't looking for anything logical, like money. They can't be bought, bullied, reasoned, or negotiated with. Some men just want to watch the world burn.

If you agreed to the covenants, I don't see why not?

Thanks for the answers. I installed a nonapproved gate on my property and have received notices that I must conform my residence to the CC&R's or face financial penalty. Problem being my gate cost a lot more than some stupid 50 buck monthly fee.
