  • Man who videotaped Erin Andrews gets 30 months in jail

    http://latimesblogs.latimes.com/lano...in-prison.html

Also ordered to pay approx $8K in restitution, allegedly to go towards attorney fees. Something tells me she spent way more than $8K in fees.

This case is an interesting intersection of celebrity voyeurism and common decency.

As everyone likely knows, Erin Andrews is considered to be one of the most attractive women in broadcasting. In short, many guys think she is hot. As a result, many guys would opt to see her naked had she posed in a magazine. However, there was a line that was crossed here that went beyond prurient interest and into the realm of sexually predatory behavior. As a result, we saw a bit of a backlash, with bloggers and talk show commentators alike uniting in the complete impropriety of this, even as locker room fantasy.

Outside the courtroom today, EA stopped to speak to the press and she broke down a bit, likely a combination of relief, anger, but unfortunately humiliation. Through no fault of her own, this guy has subjected her to taunts in stadiums and the knowledge that wherever she goes now, half the guys in the room have seen her naked and basically violated her. I felt really sad for her.

30 months doesn't seem harsh enough for this guy, esp in light of the fact that he has done this to many other women.

I can't help but think that Erin Andrews's dad had to refrain from not killing this guy, truthfully.
    Fitter. Happier. More Productive.

I don't know what someone should get for doing it once, but after doing the same thing to many other women, he should be getting a lot more time and paying a lot more in fees.

I think he should be pilloried while his victims are allowed the chance to give him as many kicks to the crotch as they'd like.

          That's probably a good start.

Dude should be tied to a flag pool in downtown NY city naked to face the humiliation of his less then endowed self all the while facing the angry women of NY blasting him in the crotch for days on end..

30 months is all this guy gets?!!?!? Really?? I think this case is being treated much like women predators who prey on teenage boys. The boys are looked at differently (As in they scored with an older chick). In this case. All the men are showing their true self by making light of this whole ordeal.

            Truly sad in all directions...

I thought I read that he got the maximum sentence possible. Am I wrong?

Don't forget that in 30 months he'll emerge with a gaping cornhole comparable to OJ Simpson's.

Aside from the fact the sentence was too short, who are the a-holes who taunt Erin Andrews because of this? How much of a POS do you have to be to make fun of a woman because she was violated?
Part of it is based on academic grounds. Among major conferences, the Pac-10 is the best academically, largely because of Stanford, Cal and UCLA. “Colorado is on a par with Oregon,” he said. “Utah isn’t even in the picture.”

Exactly. It's bad enough that she was violated by a worthless POS, but to have to endure taunts from dickheads in the stands?

                    Inexcusable.

Hey, I got news for you - being emasculated in public by angry women is just the way NYC rolls. And the naked part has already been taken and copyrighted. Maybe downtown Omaha would be a better pick.

How have so many people seen the pictures (video?)? Is the website(s) that is showing this outside the US, or is it legal to show something once it has been "released" on the internet, even without the subject's permission? I'm sure many of the celebrities who have their pictures on the National Enquirer or TMZ would prefer they were never shown, does it have to involve nudity or the fact it was taken in what Ms. Andrews assumed was private make a difference? I know nothing of the legalities of these areas, but am intrigued.

she had a reasonable expectation of privacy. the standard paps pics you see on websites or in tabloids are taken when the celebs are in public places or when they have no expectation of privacy. there is a murkier line when paps climb trees to photograph people in their backyard (a la Jennifer Aniston).

In EA's case, she is in her hotel room behind closed doors, so her attorneys issued some sort of C&D and any website streaming the vids or hosting the pics would be sued. Most of the pics came down pretty quickly. Also, someone (rumors that it was the EA camp) circulated a virus masquerading as the video. The virus affected many computers and this further discouraged dissemination.

As of now, if you search, you could still probably find the vids and pics (screen caps) pretty easily, but it would at least require some searching and effort.

Unfortunately, you can never totally eliminate images from the internet because someone somewhere will have made a copy.

EA's attorneys also wisely obtained a copyright on the vid which is a common practice in Hollywood. Sometimes described as "sex tape strategy," you will often see celebs copyrighting their own sex tapes so that they can at least sue for damages or negotiate huge fees for the dissemination of their vids. Pamela anderson, paris hilton, and most recently Kim Kardashian did this. I think the Kim/Ray J vid sold for around $5M, so there is definitely legit money to be made.

Someone like EA is not looking to sell the tape and make money (she apparently has some shame, class, and common decency), so any action she pursues would likely be a punitive measure, not for profit.

she won't to pursue civil charges, though, will she? Seems like she just wants the whole thing over.

don't know but I doubt it. the guy doesn't have deep pockets and he was found guilty in the criminal trial. Since he is already going to go to jail and given that he doesn't have a bunch of cash, there may be little point in a civil suit.

some of our actual litigators here might have a more qualified opinion on that, though. mine is an uneducated guess.
