        I don’t know the answer. I’m a Toobin admirer. So I’m torn. But I wonder what would happen if the guy in the mail room did this.

          I hate cancel culture so much. Every time anybody (on either side) messes up the mob clamors for the person to be fired. So stupid.

          This guy has suffered plenty. Clearly he did not intent to expose himself.

              This isn’t cancel culture give me a break. This isn’t some innocent mistake either, he literally masturbated on camera during a work zoom.

              Any janitor in America caught jerking off in a bathroom stall while on a work break would be fired.

              And it’s not like this is his first sexual controversy. The dude cheated on his wife, had a kid, denied the kid was his and was forced to have a paternity test.

                  Just because there wasn’t malicious intent doesn’t mean the mistake was innocent. It’s not like he was dropping his kids off at school in his robe and while shuffling his kids out of the van his penis made an appearance.

                  He should be fired because he masturbated, on a video, in front of coworkers and technically the world. How does anyone view any of his work over the next 1-2 years without referencing this incident. As an employer why put up with the liability?

                  His personal life is a piece to this because it may demonstrate the dude might not have much discipline with his penis. You want to get your political/law takes from a dude who doesn’t know how a condom works?

                    Its not innocent because taking your penis out and masturbating in what amounts to "public" now is not innocent, even if you thought you weren't being observed. He didn't accidently leave his fly down or something.

                    I had a hard time with this one. Ultimately I thought he should be fired, but I was close to saying give him another chance. I could still be persuaded of the latter. But I don't think this was exactly innocent. Some of the witnesses described him looking at what they thought was another screen. Probably had pornhub up on his other laptop.

                        Yeah, not sure how this is "cancel culture" (whatever that means). The guy was caught masturbating during work on a work video chat. Seems like it would be a fireable offense for anyone.

                        (BTW, can you imagine a more boring zoom call (pre-masturbation, obvs; I'll bet people perked up then!)? Sounds like they were war-gaming the election? With JT representing the "courts?" Woof.)

                          Sorry Dude, I'm aiding with fusnik on this one. Toobin could claim Costanza ignorance, but it should be well understood - especially by an attorney - that masturbating during a Zoom call is cause for termination. That should easily cover any "for cause" termination requirements at the New Yorker.

                          CNN might have more trouble terminating him for cause since the Zoom call was not connected to CNN. There's probably some clause that covers them in this type of situation, though.

                              This is an odd definition of "not innocent". Crazy me, I thought that issue had something to do with intent.
